22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, and a virtual tour of the program.
A monitoring inspection was initiated on 2/22/2022 and concluded on 2/23/2022. The director was contacted by telephone and a virtual inspection was conducted. There were 18 children present, ranging in ages from 5 months to 5 years, with 3 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 2 child records and 2 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on review of two staff files, the facility failed to deny employment to anyone who has been convicted of any barrier crime within or outside the Commonwealth. Fingerprint checks are required to be conducted prior to hire. Evidence: Staff C (date of hire 1/17/2022) worked in the facility until February 18, 2022 when the fingerprint was returned with a "not eligible" status for employment in child care.

Plan of Correction: Fingerprint results will be obtained prior to employment.

Standard #: 8VAC20-770-60-B
Description: Based on review of two staff files, the facility failed to have a sworn disclosure statement for each employee prior to employment. Evidence: Staff B (date of hire 10/18/2021) did not have documentation of a sworn disclosure statement on file.

Plan of Correction: Staff B will complete a sworn disclosure statement if the original can not be located.

Standard #: 8VAC20-770-60-C-2
Description: Based on review of two staff files, the facility failed to have documentation of a completed search of the central registry (CPS check) within 30 days of employment. Evidence: Staff B (date of hire 10/18/2021) did not have documentation of a completed search of the central registry on file.

Plan of Correction: If the CPS check can not be located, a new one will need to be completed.

Standard #: 8VAC20-780-160-A-1
Description: Based on review of two staff files, the facility failed to have documentation of a tuberculosis test or screening at the time of employment and prior to coming into contact with children. Evidence: Staff A (date of hire 12/20/2021) did not have a tuberculosis test or screening on file.

Plan of Correction: Staff A stated she would make an appointment today for a TB test or screening.

Standard #: 8VAC20-780-70
Description: Based on review of two staff files, the facility failed to have all required documentation in each staff file. Evidence: Staff B did not have documentation of two references prior to employment and did not have documentation of having received orientation.

Plan of Correction: All staff files will be completed as required.

Standard #: 8VAC20-780-350-B
Description: Based on staff interview and virtual tour of the facility, the facility failed to have the required staff to child ratios. Evidence: the staff to child ratio for infants (birth up to16 months) is 1 staff for every 4 infants. The staff to child ratio for toddlers (age 16 months up to 24 months) is 1 staff for every 5 children. During the inspection, there was one staff alone with children ages 5 months to 23 months).

Plan of Correction: A staff person called out sick. Ratios will be maintained as required.
