Technical Assistance:
Today we discussed "hire dates" (employment) versus the date a staff begins working (assuming job responsibilities) and how they relate to timing requirements for Background checks and orientation training. In order for the department to ascertain whether certain requirements are met with regard to timing, these dates will need to be documented specifically in staff records if they differ.

Staff should not be "hired" (employed) until the results of the federal Criminal Record Check is received back.

Program specific orientation training must be completed prior to the new staff working alone with children and no later than 7 days after they assume job responsibilities.

New staff must receive the required written policies / procedures / documentation prior to working alone with children and within 7 days of employment.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interview and a virtual tour of the facility.

A monitoring inspection was initiated and concluded on 3/17/2022. The area manager was contacted by telephone and a virtual inspection was conducted. There were 25 children present, with 3 staff during the inspection. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 2 child records and 2 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Based on a review of records and interview, the licensee was unable to demonstrate that a central registry finding is obtained for every staff within 30 days of employment or volunteer service.

Evidence:
Two staff records were reviewed.
The record for staff #2 did not contain results of a Search of the Central Registry.
The area supervisor confirmed that this documentation was not available.

Plan of Correction: A Search of the Central Registry for staff #2 will be requested within 10 days and the results will be filed in the staff record and a copy will be forwarded to the licensing inspector upon receipt.

Standard #: 8VAC20-780-160-A-1
Description: Based on a review of records and interview, the licensee did not ensure that each staff submits documentation of a negative Tuberculosis screening at the time of employment and prior to coming into contact with children.

Evidence:
Two staff records were reviewed.
The records for staff #1 and Staff #2 did not contain documentation of a negative Tuberculosis screening.
Staff #1 was hired 9/15/2020 and staff #2 was hired 6/10/2021.
Staff #1's record had documentation of a Tuberculosis (TB) test being administered, but did not contain the results of the test.
The regional supervisor confirmed that the TB screening results were not in either staff's record.

Plan of Correction: Staff #1 and Staff #2 will both obtain a new Tuberculosis screening within 10 days and results will be filed in their staff records.

Standard #: 8VAC20-780-60-A
Description: Based on a review of records and interview, the licensee did not ensure that each enrolled child has a complete record containing all required documentation.
Evidence:
Two children's records were reviewed.
The record for child #2 did not contain addresses for the 2 emergency contacts listed on enrollment paperwork to be contacted in case of an emergency if he child's parents cannot be reached.
The regional supervisor confirmed that this information was not in the child's record.

Plan of Correction: The emergency contacts' addresses will be obtained and added to the child's record within 1 week.
