An unannounced monitoring inspection was conducted to investigate a self-reported incident received by the department related to a Forbidden Action. The inspection was initiated on 3/9/2022 and concluded on 3/22/2022 with an exit interview. Interviews were conducted, observations were made on site and documentation was reviewed.
The evidence gathered during the inspection supported the allegation of non-compliance with one standard or law and the violation was documented on the violation notice issued to the program. Standard #: 8VAC20-780-410-1 Description: Based on multiple interviews, it was determined that a forbidden action was used on a child in care. Evidence: On 3/8/2022 at approximately 4:20 pm, staff #2 witnessed child #1 arrive on the playground wearing handcuffs on both hands. Child #1 proceeded to remove the handcuffs and run away. Staff #1 then chased child #1, caught them, and placed the handcuffs back on. Staff #1 then walked child #1 by the arm, in handcuffs, over to the fence and removed the handcuff from the child's right hand and attached the handcuff to the fence. Child #1 removed the handcuffs and staff #1 replaced them repeatedly. Staff #2 stated that they observed child #1 going back into the classroom approximately 20 minutes later still in handcuffs. Staff #1 admitted that they handcuffed the child because the child was hitting and kicking and not listening. Plan of Correction: Staff is no longer employed at this center.
