**The applicant must send evidence to the licensing inspector that the background checks have been requested no later than 10 days of this notification. The applicant must also then forward the results to the licensing inspector upon receipt.**
- Comments:
-
A complaint inspection was initiated and concluded on 1/11/2022 regarding two separate reports received in the licensing office on 12/07/2021 and 1/7/2021. Both reports related to standards in the areas of Staffing and Supervision and Programming. The inspector reviewed compliance in the areas of administration, staffing and Supervision, Programming, Administration, Staff Qualifications and Training, Background Checks and Child Abuse and Neglect / Reporting. A total of 7 staff records and one Child's record were reviewed. Eight Staff were interviewed jointly with a Child Protective Services worker. Relevant documentation, policies and procedures were reviewed.
Based on the information gathered, there was not sufficient evidence to support the allegations, so the complaints are found to be not valid. However, non-compliances which were not part of the stated complaint but were discovered in the course of investigating the complaint are identified documented on the violation notice issued to the program.

Standard #: 22.1-289.035-B-4 Complaint related: No Description: Based on a review of records and interview, the licensee did not obtain a copy of the results of a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
Seven staff Records were reviewed.
The record for staff #4 who was hired 11/1/2021 contained a Sworn Disclosure Statement indicating that she resided in North Carolina and in New York within the past 5 years.
There were not results of a search of the child abuse and neglect registry for North Carolina and New York.
There were not results of a abuse and neglect registry search for North Carolina and New York.
The program director confirmed that she had not obtained the search of the child abuse and neglect or the abuse and neglect registry search for North Carolina or for New York.
The program director stated that this staff was no longer working at the center as of January 6, 2022.Plan of Correction: The licensee will ensure that, when hiring new staff, the Sworn Disclosure Statement will be carefully reviewed and out of state background checks will be obtained before 30 days of employment.
Standard #: 8VAC20-770-60-C-2 Complaint related: No Description: Based on a review of records and interview, the licensee did not have a central registry finding for every staff within 30 days of employment.
Evidence:
Seven staff records were reviewed.
The record for staff #6 who began employment on 12/13/2021 did not contain the results of a Search of the Central Registry.
The program director confirmed that she did not have the results, and that she did not have documentation showing that it was requested or that she had contacted the agency to follow up on results.Plan of Correction: A request for staff #6's Search of the Central Registry will be sent out within 10 days. Upon hiring new staff the program director will send out requests for a Search of the Central Registry to be conducted within 10 days of hire. A copy of the request form as well as the form of payment will be maintained in the staff record and the agency will be contacted to follow up on results not received within 30 days. Follow up contacts will be documented and kept in the staff record as proof of action.
