22.1 Early Childhood Care and Education

Technical Assistance:
Technical assistance was discussed with the Director regarding: the timing of the Health Inspection and documenting follow-up, the requirement for Preservice training for new staff, and the requirements for out of state background checks.

Comments:
An unannounced monitoring inspection was conducted on 3/9/22 from 10:45am to 1:30pm with the Director. There were 83 children in care, ranging in age from nine-weeks to five-years-old, supervised by 14 staff. The children were observed studying the Statue of Liberty, napping, reading books, having diapers changed, "cooking" apple pie, making "sushi" with sun butter, cereal, and bananas, playing in centers, and making smoothies. Six child records and six staff records were reviewed. The Center has multiple staff trained in Daily Health Observation as well as Medication Administration Training. Each class has at least one staff with current CPR and First Aid certification. One emergency medication, the coordinating authorization form, and allergy care plan were reviewed and were in compliance. The attendance and emergency drill log were reviewed. Lunch today was pasta, green beans, fruit, and milk.

Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by close of business on 3/30/22. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review of six staff records, the center did not obtain the results of a criminal history record check, sex offender registry check, or a search of the child abuse and neglect registry from all states in which staff members have resided within the past five years within the required timeframes.

Evidence: 1. Staff #1 disclosed on their sworn statement (dated 11/16/21) that they had lived in the state of Michigan within the past five years. A criminal history check and sex offender registry check from Michigan were required prior to hire. The record for Staff #1, with a start date of 11/16/21, contained documentation of a criminal history record check dated 1/27/22 and did not contain documentation of a sex offender registry check. A child abuse and neglect (CPS) registry check was required from Michigan within 30 days of hire. The record contained a CPS check from Michigan dated 2/2/22.

2. Staff #2 disclosed on their sworn statement (dated 7/2/20) that they had lived in the state of Washington within the past five years. For staff hired prior to 7/1/20, a criminal history check was required by 12/31/20 for any state in which staff had resided within the previous five years. The record for Staff #2, with a start date of 12/23/19, contained documentation of a criminal history record check from Washington dated 5/4/21.

3. Staff #3 disclosed on their sworn statement (dated 1/13/20) that they had lived in Missouri and Kansas within the past five years. Sex offender registry checks from Missouri and Kansas were required by 12/31/20 for staff hired prior to 7/1/20. The record for Staff #3, with a start date of 1/13/20, did not contain sex offender registry checks from Missouri or Kansas.

Plan of Correction: All staff out-of-state background checks will be obtained prior to their start date as applicable and as stated on their sworn statement.

Standard #: 8VAC20-780-160-C
Description: Based on review of six staff records, the center did not ensure that all staff members obtained and submitted the results of a follow-up tuberculosis (TB) screening at least every two years. Evidence: The most recent TB screening on record for Staff #2 was dated 12/17/19. The most recent TB screening on record for Staff #3 was dated 1/11/20.

Plan of Correction: All staff TB tests will be renewed within the two year timeframe.
