Comments:
An unannounced complaint inspection was conducted on 03/28/2022. There were 29 children, ages 8 months-4 years, 6 staff providing direct care and supervision and various support staff present during the inspection. The inspector interviewed 8 staff members, reviewed 4 children?s and 2 staff records and reviewed required policy and procedures. The information gather during the inspection did not support the complaint and therefore the complaint was determined to be not valid. Information gathered during the course of the investigation determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Description: Based on the review of required policies and procedures and interviews with staff, the center failed to maintain the operational responsibility of the licensee to ensure that the center?s activities, services and facilities are maintained in compliance with the center?s own policies and procedures that are required by the standards.

Evidence:
1. Observation confirmed that on 03/28/2022 Staff did not follow the centers safe sleep practices that are a required component of the centers shaken baby syndrome/abusive head trauma procedures.
2. The center?s safe sleep policy states ?when an infant unexpectedly falls asleep during another activity (e.g. mealtimes, story time, in a bouncer or swing), the infant will immediately be taken to a crib and laid down on their backs to sleep?.
3. Four of the five children present in the infant room on 03/28/2022 were children observed sleeping in infant bouncers during a designated rest time while a staff member was attempting to get the 5th child asleep in a bouncer. Children were not immediately taken to a crib and laid down on their backs to sleep. The staff did not following the centers procedures.

Plan of Correction: Had a meeting with the staff on 03/28/2022 and all staff will be retrained on safe sleep again.

Description: Based on observation and discussion with staff, the center failed to ensure that cribs shall be used for children under 12 months of age.

Evidence:
1. There were five children, ages 8 months, 11 months, 12 months and 2 were 14 months, in the infant class on 03/28/2022; two of the five children were under 12 months of age.
2. Four of the five children were observed sleeping in infant bouncers during a designated rest time while a staff member was attempting to get the 5th child asleep in a bouncer.
3. The four sleeping children had blankets covering them that were close to their faces.
4. The lights in the room were off, there were no windows in the room and a nightlight was the only source of light making visibility low.
5. Staff 1 stated that that was the third time she had observed the children sleeping in the bouncers and that the staff had been told that children must sleep in crib or on cots.

Plan of Correction: Had a meeting with the staff on 03/28/2022 and all staff will be retrained on safe sleep again.
