63.2 Child Abuse & Neglect

Comments:
This inspection was conducted by licensing staff partially using an alternate remote protocol, including telephone contacts, documents review and interviews.

A monitoring inspection was initiated remotely on 3/29/2022 and concluded on 4/13/2022 in response to a self-report that was received by the department on 3/29/2022 forbidden action and behavior guidance. Two inspectors were on site on 4/7/2022 from 9:27 am-12:00 pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed.

The preponderance of the evidence gathered during the investigation validates the self-reported incident of noncompliance with forbidden action. Violations were cited regarding the center?s own policies See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on review of documentation and interview, the center did not maintain compliance with the center's own policies and procedures that are required by these standards.

Evidence:
1. The center's policy states, "All the following actions are forbidden and will result in immediate termination: Enclosure in a small, confined space or any space that the child cannot freely exit himself." (pg. 38)
2. On 3/28/2022, teacher #1 placed child #1 in time-out in the bathroom with the door closed. It was reported that child #1 cried and teacher #1 did not immediately respond.
3. Administration acknowledged in their written incident evaluation that the actions of teacher #1 were "not in compliance with our behavior guidance policies and procedures."

Plan of Correction: 8VAC20)-780-(2)-40-E : The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these
standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

Plan of Correction:
1. The center will continue to offer proper training, during orientation as it pertains to Forbidden Actions.
2. Also, each staff member will be required to complete a training for "Handling Challenging Behaviors"
3. To prevent this from occurring again we are installing half bathroom doors in classrooms of children 2-5 years of age. This will improve sight & sound supervision for all parties.

Standard #: 8VAC20-780-410-2
Description: Based on observation, review of documentation, and interview, the center did not ensure that the forbidden action of enclosure in a small confined space or any space that the child cannot freely exit himself did not occur.

Evidence:
1. On 3/28/2022 child #1 (DOE: 7/11/2018) reported that teacher #1 (DOH:3/25/2021) put him in the bathroom with the lights off and closed the door. Administration reviewed the video footage and reported the incident to the department. On the video, child #1 was observed pushing another child and making punching gestures. Teacher #1 was observed directing the child into the bathroom, closing the door and walking away. Another child opened the door revealing that the light was off. Teacher #1 came back and shut the door. The light remained off. Teacher #1 was then observed standing directly in front of the door. After 3 minutes and 48 seconds, teacher #1 opened the door and let child #1 out of the bathroom.
2. On 3/28/2022, Administration documented on an incident evaluation that "it was determined that teacher #1 used the bathroom as a time out space."

Plan of Correction: 8VAC20-780(6)-410-2: Forbidden Actions Enclosure in a small confined space or any space that the child cannot freely exit himself; however, this does not apply to the use of equipment such as
cribs, play yards, high chairs, and safety gates when used with children preschool age or younger for their intended purpose

Plan of Correction:
1. The center will continue to offer proper training, during orientation as it pertains to Forbidden Actions.
2. Also, each staff member will be required to complete a training for "Handling Challenging Behaviors" (Across locations)
3. To prevent this from occurring again we are installing half bathroom doors in classrooms of children 2-5 years of age. This will improve sight & sound supervision for all parties. The implementation of this corrective action plan will be overseen by administration.
