8VAC20-780 Staffing and Supervision.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a review of the video footage.

A self report inspection was initiated on January 14, 2022.The local agency representative and licensing inspector conducted interviews jointly and reviewed video footage. The inspector reviewed compliance areas of staffing and supervision, programs and administrative. The inspector emailed the director a list of items required to complete the inspection and conducted in person inspection.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interview and review, the center did not ensure that the center's activities were maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

Evidence:
1. Center playground safety policy states: " Children must not be left unattended/unsupervised at anytime."
2. Center policy also states: "Face-to-Name Transition sheets must be utilized prior to bringing children out on to the playground, when arriving out on the playground, and upon returning to the classroom."

3. In the interview Staff #1 and Staff #2 confirmed there was not a face to name transition sheet completed when returning to the classroom.

Plan of Correction: Staff are trained both at new hire training and at regular staff meetings on how to conduct face to name checks both before leaving the playground, and upon entry to the classroom. Management will continue to conduct random checks during this transition process to ensure compliance.

Standard #: 8VAC20-780-340-A
Description: Based on interviews and video footage, the licensee did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

1. On January 12, 2022, Staff #3 reported that Child #1 (three years old) was left on the center's fenced-in playground for approximately 8 minutes. Confirmed by video footage reviewed and interviews conducted with center staff.

2. The parent of Child #1 arrived to the classroom at approximately 4:45 to pick up Child #1. Staff #1 reported that she did not see Child #1 in the classroom. As confirmed by interviews and video footage, Staff #1 opened the door leading to the playground and Child #1 was standing at the door. Staff stated child #1 was crying and urinated on him/herself.

3. Staff #1 and Staff #2 confirmed that they did not follow the center's playground policy and procedure to complete a name to face count when transitioning back to the classroom from the playground.

Plan of Correction: The staff involved were released from employment as of January 13, 2022. All staff were retrained on proper face to name and supervision training on 1/26/22. School management and the DM will continue to do both in person and camera reviews to ensure compliance.

Standard #: 8VAC20-780-340-F
Description: Based on interviews and video footage, the licensee did not ensure that children under 10 years of age are in sight and sound supervision of staff.
Evidence:
1. On Janaury 12, 2022, child #1 ( 3 years old) was alone for approximately 8 minutes in a fenced in playground area. Confirmed by the vidoe footage that was reviewed on January 19, 2022.

2. After viewing video footage and interviewing staff, it was determined that Staff #1 opened the door that led to the playground and Child #1 was standing at the door crying.

Plan of Correction: Staff are trained both at new hire training and at regular staff meetings on how to conduct face to name checks both before leaving the playground, and upon entry to the classroom. Management will continue to conduct random checks during this transition process to ensure compliance.
