Technical Assistance:
Discussion was held on the following topics:
* The requirements for background checks for Virginia and out-of-state and the time frames for completion.
* Best practices for the treatment of confidential information.
* Maintenance of playground areas and resilient surfacing.

Comments:
A monitoring inspection was conducted on 05/11/2022 between the hours of approximately 12:15 pm and 3:45 pm. There were 170 children present, ranging in ages from 18 months to 5 years, with 61 staff supervising.
The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies and nutrition. A total of 5 child records and 5 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review, it was determined that the center did not ensure that employees that had lived out of the state of VA within the last 5 years have in their files the result of an out-of-state Sex Offender Registry search request and it was obtained prior to the first day of employment.
Evidence:
1) The records for Staff #4 (start date 05/02/2022) and Staff #5 (start date 03/14/2022) did not contain the results of an out-of-state Sex Offender Registry search request. Staff #4 and Staff #5 had declared in their sworn statement having lived out of the state of VA within the last 5 years before employment.

Plan of Correction: Ensure that the employees that had lived out of the state of VA within the last five years complete an out-of-state Sex Offender registry. The center will develop and immediately implement a new checklist that requires a thorough review by the HR assistant and a supervisor.

Standard #: 8VAC20-770-60-B
Description: Based on record review, the center did not ensure to obtain a completed Sworn Statement prior to first day of employment.
Evidence:
1) On the date of inspection, the record for Staff #5 (start date 03/14/2022) did not contain a completed Sworn Statement. A Sworn Statement form was found in Staff #5's record, however, it was not filled out nor signed.

Plan of Correction: Ensure that all Sworn Statements are fully completed before the employee's first day of employment. The center will develop and immediately implement a new checklist that requires a thorough review by the HR assistant and a supervisor.

Standard #: 8VAC20-780-40-M
Description: Based on observation, the information in the current written list of all children's allergies, sensitivities, and dietary restrictions was not always kept confidential.
Evidence:
1) On the date of inspection, allergy lists in Toddler 1A and Toddler 1B rooms were observed posted in plain sight in a way that information was easily visible with no cover sheet or protector.

Plan of Correction: The Allergy list from both toddler classrooms will be immediately removed A training with regards children's confidentiality will be held for all the staff members in our next staff meeting.

Standard #: 8VAC20-780-60-A
Description: Based on record review, children's records did not contain all required information.
Evidence:
1) The records for Child #1, Child #2 and Child #4 did not contain the work phone number and place of employment of their parent who have custody.

Plan of Correction: Parents will be required to fully complete the employment portion. Parents who have non-traditional jobs and work on different locations everyday will be asked to list their cell phone number as their work number.
