Comments:
A complaint inspection was initiated on May 2, 2022 and concluded on June 1, 2022. The inspector reviewed compliance in the areas of administration, staffing and supervision, staff qualifications/training, special care and emergencies. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-40-E
Complaint related: Yes
Description: Based on interviews of staff and review of documentation, facility did not ensure that the center?s activities, services, and facilities are maintained in compliance with the centers own policies and procedures that are required by these standards.

Evidence: Facility Staff Policies state, ?All children and adults must wear seat belts or be in car seats when riding in a van. Check these personally to make sure they are hooked properly.? Staff #1 stated she did not verify child #1?s car seat was properly secured with the seat belt before transporting child on April 25, 2022.

Plan of Correction: Met with all the van drivers and reinforced the policy. Made a booster seat checklist for each child and that is on the van clipboard detailing which type of seat the child is to use.

Standard #: 8VAC20-780-580-C
Complaint related: Yes
Description: Based on interviews of staff, facility did not ensure Virginia state statutes about safety belts and child restraints are followed as required by the Code of Virginia.

Evidence: On April 25, 2022, staff #1 was transporting children to school when there was an unexpected obstruction in the road causing staff #1 to brake suddenly. Child #1, age 5, was strapped into a 5-point harness car seat in the second row of van seating; however, the car seat was not secured to the van seat. Upon the sudden breaking, the child and car seat fell forward into the seat in front of the child. Staff #1 confirmed this car seat is occasionally removed and she had not verified that the car seat was properly secured with the seat belt before leaving the facility.

Plan of Correction: Every child and car seat are checked before departing. Program Director also assists in verifying car seats are secured before leaving.
