Comments:
A self report inspection was initiated on March 28, 2022. Joint investigation was conducted with local agencies/ authorities. Interviews were conducted, video footage was reviewed and documentation were reviewed. The inspector reviewed compliance areas of staffing and supervision, programs, administrative, staff training and qualifications and special care provision emergencies. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-410-2
Description: Based on video footage observation and staff interview, the center did not ensure equipment such as a crib was used for intended purposes and a child was enclosed in a small, confined space where the child could not freely exit himself .

Evidence: On March 16, 2022, Child #1 was standing in his crib at 12:37pm. Staff #1 was spraying the floor and wiping the floor at 12:46pm . Staff #1 picked up Child #1 for a diaper change at 1:00pm and put him back in his crib at 1:03pm - 2:10pm. Child #1 was awake and standing in the crib from 1:03pm-2:10pm. Staff #1 and Staff #2 comfirmed in thier interviews, child#1 was not taken out of the crib because the child is mobile and they needed to wait until the floor was dry. Observed on video footage provide by the center.

Plan of Correction: All staff currently working in our infant rooms (as of March 20, 2022) have been trained and are monitored by our school leadership team daily for compliance with infant positioning. Staff are trained on how to manage infants should the floor have to be cleaned while infants are active. DM also does unannounced visits at least monthly, and weekly camera reviews to ensure compliance.

Standard #: 8VAC20-780-340-A
Description: Based on staff interview and video footage, the facility did not ensure the staff are ensuring care protection and guidance.

Evidence:
On March 16, 2022, Child #1 woke up at 12:36 and pulled himself up by the guard rail and was pushing his head on the railing.

From 12:37- 1:00pm child #1 standing up in the crib and is pushing, rubbing and hitting his forhead , top of his head and face on the on the side and on the the front of the crib approximatley 42 times.

Between 12:44 - 1:00pm Staff #1 passes child #1 crib spraying the floor and mopping floor approximatley three times. Staff #2 does a crib check once.


At 1:00pm Staff #1 took Child #1 out of the crib for a diapering change and put him back in the crib at 1:03pm.

Staff #1 and Staff #2 did not interact with child # 1 between 1:03pm -2:10pm

Child #1 stood in the crib from 1:03pm -2:10pm hitting, rubbing , pushing his forhead, top of his head and face on the crib continusly approximatley 170 times. And is seen visbly crying on video footage at least twice.

At 2:10pm child #1 was taken out of the crib and fed a bottle by Staff #1.


Staff #1 and Staff #2 confirmed they notified Staff #3 about the bruising/redmark they saw on his forhead.

Pictures confirmed child#1 had bruising on his forhead and face.

Plan of Correction: The staff present this day are no longer employed by us as of this incident review. All infant staff have been retrained on proper classroom management when cleaning, child staff interactions, ensuring infants are not left for more than 15 minutes in one location- unless sleeping, and observing for potentially harmful behavior in children. Both school management and the DM do random classroom checks and video review to ensure compliance daily and weekly. School leadership has also been retrained on proper observation methods to ensure that this type of behavior is not occurring in our classrooms.

Standard #: 8VAC20-780-370-4
Description: Based on observation, the facility did not ensure comfort to infant as needed.

Evidence: Video footage from March 16, 2022 , Child #1 was observed in his crib standing for 1 hour and 7 minutes and crying during crib checks at 1:25pm and 1:42pm. Staff #1 picked child#1 up at 2:10pm to feed. Staff #1 and Staff #2 did not interact with Child #1 for 1 hour and 7 minutes.Child #1 was observed in the a crib check at 1:25 pm and 1:42 pm but staff did not interact with the child.

Plan of Correction: All staff and managers working in this school have been retrained as of March 30, 2022 on proper means of observing, treating, and reporting injuries. Child/teacher interactions for when infants are not ready for nap were also trained on as of March 30, 2022. School leaders, the school safety captain, and the DM all conduct random observations daily and weekly to ensure compliance.

Standard #: 8VAC20-780-370-5
Description: Based on video footage and staff interview, the facility did not ensure staff provide awake infants not playing on the floor or ground a change in play space at least every 30 minutes or more often as determined by the individual infant's needs.

Evidence : On March 16, 2022, Child #1 woke up from a nap and was standing in the crib from 12:37pm- 1:00pm . Staff #1 changed Child #1's diaper and returned child back into the crib at 1:03pm. Child #1 was awake and standing up in a crib from 1:03pm -2:10pm.

Video footage confirmed Child #1 was not changed out of his play space until 2:10pm. Child #1 did not have a change play space for approximatley 1 hour 30 minutes.

All infant staff have been retrained on proper classroom management when cleaning, child staff interactions, ensuring infants are not left for more than 15 minutes in one location- unless sleeping, and observing for potentially harmful behavior in children.
