Comments:
An unannounced inspection was conducted April 28, 2022 with another local agency in response to a self-reported incident regarding supervision, care and protection of children. A three year old child had bruising on the back and finger.

An investigation was conducted today in response to a self-reported incident received by our office regarding the care and protection of an infant. Based upon multiple interviews, the incident is deemed valid. Violations cited for care and protection are identified in the Violation Notice.

Standard #: 22VAC40-185-40-E
Complaint related: No
Description: Based on interviews, the center did not ensure operational responsibilities of the licensee that the center's activities were maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence:
1. The Starfish classroom outside adventure time on the playground is 4:30 pm to 5:00 pm.
2 The Sea Turtles classroom outside adventure time on the playground is 5:00 pm to 5:30 pm.
3. There were approximately 15 children in Sea Turtles classroom who were signed in during outdoor play according to the attendance record. Two staff members in this classroom.
4. There were approximately 5 children in the Star Fish classroom who were signed in during outdoor play according to the attendance record. Two staff members in this classroom.
5. Video-camera footage showed two classrooms were combined on the playground with approximately 20 children.
6. Staff were observed in the video-camera footage and interviews were not moving through the assigned zone and assisting children nearest to them. Children were observed climbing up the slides the wrong direction and sitting at the bottom of the slide as other children slide down hitting a child from behind with their feet.
6. A nonverbal child was crying approximately 29 seconds (approximately 4.83 minutes). When the child's crying became louder on the video-camera recording is when a staff went up to the tunnel area to check on the crying child.
7. Four staff on the playground did not follow the center's playground safety procedures states "staff to stay alert and attentive to realize a child can wander into a hazardous situation in less than a minute".
8. Four staff on the playground did not follow center's playground safety procedures to "observe all children and the "secret" places where they could hide".

Plan of Correction: 1. Identified the four staff members on the playground at the time of the incident. All four staff members were given a review and training of Playground Safety Procedures after the incident. Including how to assist removing an inquired child off the playground equipment properly.
2. All Staff: Review and training on Playground Safety Procedures to ensure that playgrounds are always properly and effectively supervised in accordance with the centers policies and procedures standards. Date corrected 714/022 staff meeting
3. Leadership will monitor daily scheduled playground ties for all classrooms.
Outdoor times were reviewed and updated to reflect each classroom having their individual class outside times. All staff received training not to share outside time with any other classroom.

Description: Based on interview, documents and video-camera footage, the center did not ensure the child's physical, intellectual, emotional, and social well-being and growth, staff interact with the child and one another to provide needed help, comfort, support.
Evidence:
1. Video-camera footage showed several children running in and out of the tunnel on the playground. A nonverbal child was sitting down inside the tunnel.
2.Video-camera footage showed a child sitting down inside the outdoor playground tunnel. Child was crying approximately 4.89 minutesbefore a staff went to check on the child that was still inside the tunnel.
3. Staff assisted child out the tunnel and same staff held the child by wrist in which the child feet were not touching the steps to walk down.
