63.2 Child Abuse & Neglect

Technical Assistance:
To reduce the risk of choking Cut tube-shaped foods, such as baby carrots, string cheese, hot dogs, etc., into short strips rather than round pieces and avoid serving foods that are as wide around as a nickel, which is about the size of a young child?s throat

Comments:
A complaint inspection was initiated on 4/21/2022 and concluded on 4/25/2022 in response to a complaint received by the department on 4/21/2022. The inspector reviewed compliance in the areas of administration, staffing and staff qualifications, supervision, and programming, Special Services and Abuse & Neglect.
Interviews were conducted with 2 staff at the facility and additional interviews with collateral witnesses were conducted in the field.
Information gathered during the inspection determined non-compliance with applicable standards or law therefore the complaint is Valid. Violations cited were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-340-A
Complaint related: Yes
Description: Based on interviews, the licensee did not ensure that when supervising children, staff always ensure their care protection and guidance.

Evidence:
Two staff (staff #1 and Staff #2) were interviewed at the facility on 4/21/2022. Child #1 was interviewed in person on 4/21/2022 and Child #1's guardian (adult #1) as well as an outside contractor (adult #2) who was present in the facility near the area where the incident occurred was interviewed via telephone.

Staff #1 confirmed during her interview on 4/21/2022 that on 4/14/2022 she took the child by the arm in an attempt to stop her from running out of the classroom and that child #1 stated to her "you hurt my arm".
Staff #1 stated that she did not look at child #1's arm at that time, but was made aware of red marks left on her arm several days later when child #1's grandmother contacted her and showed her pictures of the red marks on child #1's arm.
Staff #1 stated during the interview that she responded to child #1's grandmother showing her the pictures of red marks on the child's arm "Oh wow - maybe my fingernail pinched her".

Plan of Correction: A plan of correction will be completed and returned to the inspector within 5 days (by 7/13/2022).
The following written response was received on 7/13/2022:
"Staff will adequately care for children."
"Staff will clip nails."

Standard #: 8VAC20-780-560-F-4
Complaint related: No
Description: Based on observations and interview, the licensee did not ensure that children 3 years of age or younger are not offered foods that are considered to be choking Hazards.

Evidence:
The licensing inspector observed a group of toddlers sitting at a table in the area adjacent to the infant classroom. The children in this group were identified by staff #1 as Toddlers between 16 and 23 months of age.
Children were observed being served a hotdog which had not been sliced lengthwise or otherwise. The toddlers were picking up the hot dog and biting off chunks which poses a choking hazard to young children.

Plan of Correction: A plan of correction will be completed and returned to the inspector within 5 days (by 7/13/2022).
The following written response was received on 7/13/2022:
"Staff will cut hotdogs"
