An unannounced inspection was initiated on 07/19/2022 in response to a complaint that was received on 7/14/2022 regarding allegations in the area of toileting procedures. The inspection was initiated on 07/19/2022 and completed on 07/26/2022. On 07/19/2022, the inspector was on site from 10:40 am-1:00 pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional interviews were conducted remotely.
The preponderance of the evidence gathered during the investigation does not support the allegations; therefore, the complaint is determined to be not valid. Though not a part of the original complaint, there were violations found during the inspection regarding supervision of children. See the violation notice for more details. You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Standard #: 8VAC20-780-340-C Complaint related: No Description: Based on interview, the center did not ensure that during the stated hours of operation, there was always on the premises when one or more children were present one staff member who met the qualifications of a program leader or program director and an immediately available staff member, volunteer or other employee who was at least 16 years of age, with direct means for communication between the two of them.
Evidence:
1. During interview, staff stated that there have been days where there is only 1 staff between the hours of 6:30 am and 7:00 am. Staff confirmed that children were present during the 30 minute time period.
2. Administration acknowledged that there had been occasions when 1 staff was alone with children before the second teacher arrived at 7:00 am.Plan of Correction: As the administrator I will always ensure that there are two staff members who meet the qualifications present at the opening of the daycare at 6:30 am. I also as the administrator will be one of them until all staff have met the qualifications to do so.
Standard #: 8VAC20-780-340-D Complaint related: No Description: Based on record review and interview, the center did not ensure that in each grouping of children at least one staff member who met the qualifications of a program leader or program director was regularly present.
Evidence:
1. Teacher #5 (DOH:8/23/2021) identified herself as the lead teacher in the three's room. Teacher #5 stated that she works from 7:00 am-1:00 pm or 7:00 am-4:30 pm. On the days that teacher #5 leaves at 1:00 pm, she stated that teacher #4 (DOH:8/23/2021) sometimes steps in to supervise the classroom. Teacher #4 confirmed the statement. Teacher #4 identified herself as an assistant teacher. The record of teacher #4 did not contain documentation of lead teacher qualifications.
2. Administration acknowledged that when teacher #4 was alone in the afternoons after teacher #5 departed, there was not a lead regularly present.Plan of Correction: Upon teacher #5 leaving for the day and when staff #4 moves into the room, I the administrator will go into the room to help out staff #4 or any other staff member until all staff qualifications have been met to become a lead teacher.
