Technical Assistance:
Discussed the importance of timely reporting of suspected abuse.
Recommended mandated reporter training for all staff and in-service on forbidden actions.

Comments:
A self-report was received on 06/17/2022. An Unannounced Monitoring Inspection was conducted today to investigate two incidents involving forbidden actions by a staff member that occurred on 06/15/2022 and 06/16/2022. Staff and parent interviews were conducted, staff records and written statements reviewed and observation of the toddler classroom was completed. Violations were found in the following areas: Administration and Programs. Thank you for your cooperation during the investigation. Description: Based on interviews and staff written statements, a suspected incident of child abuse was not reported in accordance with ? 63.2-1509 of the Code of Virginia.

1. Staff #2 and #4 observed a suspected incident of physical abuse on 06/15/2022.
2. When interviewed, Staff #4 stated ?I didn?t say anything, I figure the lead [Staff #2] would say something.?
3. Staff #2?s signed written statement dated 06/23/2022 stated ?[Staff #3 and #4 were present. [Staff #4] witnessed a portion of the occurrence and we looked at each in shock.?

4. When interviewed, Staff #2 stated ?I asked [Staff #5] to remove her from the class, ?[Staff #5] asked me if I need to call CPS. I told [Staff #5] I fear retaliation.?

5. The incident of suspected physical abuse of a child observed by staff on 06/15/2022 was not reported immediately to the local department of social services as required. It was reported at 9:32am on 06/17/2022.

Description: Based on staff interviews and staff written statements, one staff used forbidden actions with 2 children.
Evidence:
1. On 06/15/2022, Staff #2 and #4 observed Staff #1 roughly handling Child #1 (age 2 years).


a. When interviewed, Staff #2 stated ?[Staff #1] yelled at [Child #1] and she grabbed [Child #1?s] right arm from behind and she dragged [Child #1] to the bathroom and I saw [Child #1?s] legs dragging.?

b. Staff #2?s signed written statement dated 06/28/2022 stated ?I witnessed [Staff #1] calling the child to use the bathroom for a diaper change. This occurred around 12:10pm during lunch and transition to nap time. [Staff #1] was loud and her tone sounded rude and harsh. [Staff #1] grabbed the child?s right arm and pulled [Child #1] too hard. [Staff #1] dragged the child into the bathroom while the child cried.?



c. When interviewed, Staff #4 stated ?I saw [Staff #1] grab [Child #1] from behind and I saw [Child #1?s] feet were dragging. [Child #1] was crying at the time.?

d. Staff #4?s signed written statement dated 06/22/2022 stated ?between 12:00pm a teacher her name is [Staff #1], she pulled [Child #1] hard from his arms and dragged him over the bathroom door?.

2. On 06/16/2022, Staff #3 and #4 observed Staff #1 grabbing Child #2?s (age 2 years) chin and yelling at the child.

a. When interviewed, Staff #3 stated ?[Child #2] was crying and [Staff #1] grabbed [Child #2?s] chin and yelled ?I don?t care about your crying, shut up and eat your food?.

b. Staff #3?s signed written statement dated 06/22/2022 stated ?I saw [Staff #1] that she was forcing [Child #2] to eat?. The written statement included Staff #1 was overheard stating ?I don?t care if you want it or not.?

c. Staff #2?s signed written statement dated 06/23/2022 stated ?[Staff #1] was helping me with the cot and said out loud ?I hate [Child #2]. I hate this kid. He is horrible!? and ?the child heard the statement.?

Plan of Correction: Staff using forbidden actions was terminated from the company on 6/16/2022 2. Report was made against staff using forbidden actions once all staff witnesses and potential witnessed were interviewed. Report made on 6/17/2022
