63.2 Child Abuse & Neglect

Comments:
A self-reported allegation was received by the Fairfax Licensing office. Center administration reported that a staff member used prohibited behavior guidance. The investigation began on July 7th, 2022 with local government agencies and was completed on July 29th, 2022. The inspection included interviews with the child, management team, teachers, a review of written staff statements, and a review of staff records. The preponderance of evidence supports the allegation and the report is valid. Areas of non-compliance are identified in the Violation Notice. Standard #: 22.1-289.035-B-4
Description: Based on staff record review, there was no out of state Central Registry results for employee?s who have lived outside of Virginia in the past 5 years.

Evidence:
1. Teacher 1 (date of hire 4/19/2021) did not have out of state Central Registry results within 45 days of hire.

Plan of Correction: That all staff files will be reviewed so that anyone who lived out of state will have an Out of State placed in their file. Central Registry search completed and results

Standard #: 8VAC20-780-410-1
Description: Based on interviews and written teacher statements, one staff member engaged in a forbidden action resulting in the injury to a child.

Evidence:
1. Teacher 1?s written statement stated ?I began to forcefully grab child?s* arm, pinch her.? [sic]
2. Teacher 2 stated ?she heard crying on the other side of the playground equipment. When she asked the child what happened the child said that ?teacher grabbed her.?

Plan of Correction: All staff will be trained on Positive Guidance and Physical Interactions and copes of signed policies

Ongoing observations be center leadership will take place regularly will be placed in staff files
