A complaint investigation was initiated on 7/20/2022 and concluded on 8/15/2022. The complaint consisted of allegations received by the Northern Licensing Office on 7/18/2022 regarding forbidden actions and behavioral guidance. Based on interviews and documentation a preponderance of evidence supports the allegations regarding forbidden actions and behavioral guidance. Therefore, the complaint is determined to be valid. Areas of non-compliance are identified in the Violation Notice.
Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the Violation Notice, and then return a signed and dated copy to the licensing office by 5pm on 8/22/2022.

Standard #: 8VAC20-780-400-B Complaint related: No Description: Based on multiple interviews, it was determined that staff did not ensure behavioral guidance was constructive in nature, was age and stage appropriate, or that was intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. On 7/15/2022, in the School Age room, the children were reportedly exhibiting behavioral issues, including pushing tables and arguing. Staff #1 began yelling and cursing at the children stating ?you guys don?t follow the d**n rules and every day this happens?. Staff #1 ?got mad and started swinging their hand on the wall where the classroom rules were?hit the wall 4 times?it sounded like a big bang each time?. While hitting the wall, Staff #1 tore and crumbled the posted classroom rules. Interviews also revealed that Child #2 had to move their head quickly to avoid being hit by Staff #1 when they began hitting the wall.
2. On approximately 7/14/2022, in the School Age room, Staff #1 stated to another school age child ?If you don?t shut up I?m going to go over there and put you in a chokehold?.Plan of Correction: Gave staff trainings in regard to positive guidance and stress management. Also gave a written warning in his file about appropriate tones, words and actions. If staff returns will monitor actions in class. Staff is suspended at this time.
Standard #: 8VAC20-780-410-6 Complaint related: No Description: Based on multiple interviews, it was determined that staff used a forbidden action of making verbal remarks which are demeaning to a child.
Evidence: On 7/15/2022, in the School Age room, Staff #1 stated to Child #1 ?Sort them out. If you don?t get the full deck then you?re stupid?. When Child #1 wasn?t able to collect the full deck of cards Staff #1 stated ?See, you?re stupid?.Plan of Correction: Refer to items above.
