Comments:
The inspection findings have been updated as a result of a first step review completed on September 23, 2022. A complaint inspection was initiated on July 7, 2022 and concluded on August 17, 2022. There were thirty-four children present, ranging in ages from three months to five years, with six staff supervising at the onset of inspection. The inspector reviewed compliance in the areas of administration, staff qualifications/training, physical plant, staffing/supervision and programming. A total of three child records and eleven staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Description: Based on review of center documentation, facility did not ensure staff complete at least 16 hours of training annually.

Evidence: The following was found during staff record review:
1. The record for staff #1 did not have any documentation of annual training for 2021. Staff #1 occasionally comes in the classroom to intervene in managing children?s behaviors and to serve in staff-to-child ratios.
2. The record for staff #5 did not have any documentation of annual training for 2021. Staff #5 is responsible for children who are sent to the office because of behavioral issues.
3. Director confirmed there was no information regarding training completed for these individuals.

Description: Based on interview and review of center documentation, facility did not ensure each grouping of children has at least one staff member that meets qualification of program lead or program director regularly present.

Evidence: On July 7, 2022 between 10:15 am to 10:45 am, there was not at a program lead qualified staff in 2 of 3 groups of children.
1. There was not a program lead qualified staff in the 2?s classroom. Director stated Staff #2 is usually the program lead for the group however she was on a 2-hour break at the time of inspection.
2. There was not a program lead qualified staff in the preschool classroom. Director stated they do not currently have a program lead assigned to this group.

Description: Based on observation and review of center documentation, facility did not ensure there is at least one staff for every four infant age children.

Evidence: On July 7, 2022 at approximately 10:30 am, there was one staff in the infant room with five children. Child #3, age three months, was the youngest in the group.

Evidence: On August 17, 2022 at approximately 12:20 pm, there was one staff in the school age room with nineteen children. Child #5, age 5 years, was the youngest in the group.

Description: Based on staff interviews and video observation, facility did not ensure staff shall interact with the child and one another in order to provide needed help, comfort and support in order to promote the child?s physical, intellectual, emotional, and social well-being and growth.

Evidence: Video footage was reviewed and showed that on June 30, 2022 at approximately 7:39 am, child #1, age 2, was crying loudly as a family member had just left the classroom. Staff #1 entered the classroom, immediately picked up the crying child, and then carried the child sideways against the staff?s chest with one arm between each of the child?s legs. Staff #1 carried child #1 to the corner of the classroom and began stating harshly ?hush?, ?hush it up? multiple times. Staff #1 also stated, ?Quit acting like a baby. You?re a big girl.? Staff #1 did not offer needed help, comfort and support.

Description: Based on staff interviews, video observation and review of center documentation, it was determined a center staff engaged in a forbidden action of roughly handling a child and threats of physical punishment.

Evidence: On July 22, 2022, Staff #9 stated to child #2, age 5, in the P4 classroom ?If you hit me, I?ll hit you back?. Staff stated this was said in response to the child that had just hit her.

Description: Based on staff interviews and video observation, it was determined a center staff engaged in a forbidden action of verbal remarks which are demeaning to the child.

Evidence: On June 30, 2022 at approximately 7:39 am, in the 2?s classroom, Staff #1 was observed making verbal remarks that are demeaning to a child. Child #1, age 2, was crying as a family member had just left the classroom. Staff #1 stated to child #1 harshly ?hush?, ?hush it up? multiple times. Staff #1 also stated, ?Quit acting like a baby. You?re a big girl.?

Evidence: On August 17, 2022 at approximately 12:10 pm, child #4, age twelve months, was observed sleeping in a boppy in a crib.

Description: Based on observation, facility did not ensure bottles are not propped or used while the child is in his designated sleeping location.

Evidence: On August 17, 2022 at approximately 12:10 pm, child #4 was observed sleeping in a crib with a bottle of milk in the child's mouth. The bottle was propped on linens that were on the child's chest.
