Technical Assistance:

Today we discussed various ways that Program Leader Training can be documented to show the trainings that were included in the required hours for Program Leader Qualifications. We discussed medication and the options for policies regarding when and what types of medication the center agrees to administer. The decision to administer medicines at a facility may be limited by center policy to administer: 1. Prescribed medications; 2. Over-the-counter or nonprescription medications; or 3. No medications except those required for emergencies or by law. Medication may ONLY be kept in the center while it is still before the expiration date for the medication AND when accompanied by a current authorization form. Medication may only be kept at the center until it expires and should be disposed of or returned to the parent upon expiration. When the authorization form for medication is no longer valid, the medication may no longer be administered and must be returned to the parent or disposed of within 14 days. Food brought from home for children, cups, bottles, lunch boxes, etc. must all be labeled with the child's name and the date it was brought in to the center.

Comments:

A monitoring/renewal inspection was initiated and concluded on 8/19/2022. At the time of the inspector's arrival, there were 68 children present, ranging in ages from 2 1/2 months old to 10 years old, with 12 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 5 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:

Standard #:	8VAC20-780-70
Description:	Based on a review of records and interview, the licensee was unable to demonstrate that each staff record had all of the required documentation. Evidence: Five staff records were reviewed during today's inspection. The records for staff #1 and staff #2 did not contain documentation of the date of employment or service. The records for staff #1, staff #2, staff #3, staff #4, and staff #5 indicated their position as Lead Teacher but did not clearly demonstrate the staff's program leader qualifications. Each of the records contained a Program Leader training log with training hours and training topics entered, but did not indicate which of the documented training hours, during a specific period of 30 days prior through 6 months following their program leader qualification. The date of Program Leader Qualification was not documented for any of the 5 records and none of the five records contained documentation to demonstrate that they had obtained a high school diploma or equivalent.
Plan of Correction:	The licensee will submit a plan of correction within 5 days of receipt of the violation notice. The following plan of correction was received by the department on 8/27/2022: "Staff records were updated".
Standard #:	8VAC20-780-270-A
Description:	Based on observation and interview, the licensee did not ensure that areas and equipment of the center are maintained in a safe condition. Evidence: The inspector observed that the back left corner of the two year old classroom was very dark during nap time and that the children in this corner were barely visible to the inspector from the front of the classroom. Children who may need or want to get up to use the restroom or seek out staff assistance during naptime could easily trip or fall over neighboring cots or other nearby items due to the lack of light and visibility in this area. The inspector observed 5 pieces of a Styrofoam plate, on the ground along the fence line in the outdoor play area. The trash poses a choke hazard to young children who may put the pieces in their mouth. Also on the outdoor play space, there was a purple, white and pink plastic riding toy that had a 2 inch area of sharp plastic where a section plastic had broken off leaving a sharp edge and a 3 legged plastic activity table with one leg broken off of it leaving a sharp edge where the leg was missing. There was a long rope, approximately 14 feet long. lying on the ground on the outdoor play area used by children. The rope poses a strangulation hazard for children who may wrap it around their neck or the neck of another child in the context of play. It also poses a trip hazard for children running and playing outside. Staff verified that groups of children had been outside in this space for water play throughout the morning, prior to the inspector's observations.
Plan of Correction:	The licensee will submit a plan of correction within 5 days of receipt of the violation notice. The following plan of correction was received by the department on 8/27/2022: "Staff placed a lamp in room during naptime" "Staff cleaned the playground and discarded all broken toys".
Standard #:	8VAC20-780-430-B
Description:	Based on observation and interview, the licensee did not ensure that materials and equipment available are age and stage appropriate for the children. Evidence: The inspector observed staff place a sleeping "waddler" on his stomach in a crib. When the inspector walked closer to observe the interior of the crib, a small yellow, plastic 1 inch cube was observed lying on the crib mattress next to the the "waddler". The cube was small enough to be swallowed and presents a choking hazard. When the cube was shown to staff, staff stated that they did not know why the cube was in the crib but that an older child walking through the room to access the outdoor play area may have dropped it in the crib as they passed it. Staff identified the child as being part of a group of children between the ages of 12 and 16 months old.
Plan of Correction:	The licensee will submit a plan of correction within 5 days of receipt of the violation notice. The following plan of correction was received by the department on 8/27/2022: "During a meeting staff was instructed to keep cribs clear of all objects".
Standard #:	8VAC20-780-560-F-4
Description:	Based on observation and interview, the licensee did not ensure that children three years of age or younger are not offered foods that are considered to be potential choking hazards. Evidence: The inspector observed children in the "Waddler" classroom eating lunch, which included a whole, uncut hotdog, which children were picking up and biting, and fruit cocktail containing whole white grapes and halved cherries. All three of these items being eaten are circular shaped and of a size that would easily be choked on by young children. These foods are considered a choking hazard for children three years of age or younger if not prepared (cut) in a manner to lessen the risk. The staff member in charge at the time (staff #1) stated that the children in this group were between 12 and 16 months old.
Plan of Correction:	The licensee will submit their plan of correction within 5 days of receipt of the violation notice dated 8/24/2022. The following plan of correction was received by the department on 8/27/2022: "During a meeting, staff was instructed to cut hotdogs up"
Standard #:	8VAC20-780-560-G
Description:	Based on observation, the licensee did not ensure that when children's food is brought from home, the food container is clearly dated and labeled in a way that identifies the owner. Evidence: The licensing inspector observed 2 unlabeled storage containers on a table top on the infant room. When asked what they were, the staff person working in the room stated that they were containers of infant cereal.
Plan of Correction:	The licensee will submit their plan of correction within 5 days of receipt of the violation notice dated 8/24/2022. The following plan of correction was received by the department on 8/27/2022: "Staff labeled containers".
Standard #:	8VAC20-780-560-M
Description:	Based on observation and interview, the licensee did not ensure that children are not permitted to drink or eat while walking around. Evidence: The inspector observed a staff in the "waddler" room repeatedly handing out fish shaped crackers, one at a time, to children as they walked around and interacted with one another in play area between the infant and "waddler" classrooms. Staff stated that the children in this group ranged from 12 to 16 months old.
Plan of Correction:	The licensee will submit a plan of correction within 5 days of receipt of the violation notice. The following plan of correction was received by the department on 8/27/2022: "During meeting staff was instructed that children have to be seated while eating".
Standard #:	8VAC20-780-570-E
Description:	Based on observation, the licensee did not ensure that prepared infant formula is refrigerated, dated and labeled with the infant's name. Evidence: The inspector observed 2 infant bottles setting on the ledge between the infant sleep area and the center area shared by the infants and "waddlers" in the adjoining classroom. One bottle was empty and the other had approximately an inch of formula left in the bottle. When asked who the bottles belonged to, the staff person in this room confirmed that the bottles were not labeled, but identified them both as belonging to one specific infant in the group.
Plan of Correction:	The licensee will submit a plan of correction within 5 days of receipt of the violation notice. The following plan of correction was received by the department on 8/27/2022: "Staff labeled bottles".
Standard #:	8VAC20-820-120-E-2
Description:	Based on observation and interview, the licensee did not have the findings of the most recent licensing inspection of the facility posted visibly. Evidence: The inspector was unable to locate the results of the most recent inspection in the facility. The staff in charge (staff #1) confirmed that his document was not posted in the facility at the time of the current inspection.
