Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 7/29/22. Interviews were conducted with staff relating to the use of diaper cream and feeding a child a food that they are allergic to. Interviews were also held with the parent. The information gathered during the investigation supports the allegations, so the complaint is determined to be valid. Please complete the columns for ?description of action to be taken? and ?date to be corrected? for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 5 business days.


The preponderance of evidence gathered during the investigation supports violation of standards in regards to the complaint.

Description: Based on documentation review, the center failed to maintain compliance with their own policies and procedures. Evidence: Interviews with the parent and Director revealed the following:
1) On July 12, 2022 the center did not follow their written policy regarding over the counter skin products which states ?A physician?s signature or note is needed: to give medication to a child under two, including over-the-counter medication??and ? to give medication differently than instructed on the label.?

Description: Based on interviews, and documentation review, the center failed to ensure that all nonprescription drugs and over-the-counter skin products were used in accordance with the manufacturer?s recommendations.
Evidence:
On July 12, 2022 the parent of child #1, 23 months, asked teacher #1 to apply Miconozole cream to the child?s diaper area. The manufacturer recommendations state ?do not use on children under two years of age unless directed by a doctor.? The diaper cream form was filled out by the parent. When interviewed, the Director stated that the parent did not provide a doctor?s note giving the center permission to apply the Miconozole cream. Interview with the parent revealed that the child came home with a severe diaper rash.

Complaint related: No
Description: Based on interviews and documentation review, the center did not ensure that a child with a diagnosed food allergy shall not be served any food identified in the written care plan.
Evidence: Interviews with the Director and Parent revealed the following.
1) Child #1 had a written care plan that documented a food allergy to eggs.
2) The Director stated that the child was listed on the allergy list posted in each classroom as having a food allergy to eggs.
3) The child?s Physical stated that the child had an allergy to eggs.
4) On February 2, 2022 the child was served eggs, as per the daily sheet that was sent to the parent and reviewed by the Licensing Inspector via email. 5) Per phone interview with the parent she discussed with the staff that the child had an allergy to eggs and that she was concerned that the child had been served eggs.
