Comments:
The licensing inspector conducted an unannounced complaint inspection on 09/01/2022 in response to a self-report that was received in the licensing regarding allegations in the area of supervision and play equipment. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the allegation. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-330-B
Description: Based on observation the center did not ensure where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99.

Evidence:
1. On 08/23/2022 a 5 year-old child fell from one of the play structures onto the playground surfacing. The surfacing measured around 3 inches, where 6 inches is required.

2. On 09/01/2022 the center had around 3 inches of resilient surfacing underneath the slide closest to the building. Six inches is required.

Plan of Correction: Mulch was delivered on 08/24/2022. The play area where the injury occurred now has at least 6 inches of mulch underneath the equipment. That same day mulch was spread onto the other play area, however the workers did not spread it in the correct area and left half of the play structure with under 3 inches of mulch. The children are not currently permitted to play on the structure until the mulch is installed correctly.

Standard #: 8VAC20-780-340-A
Description: Based on observation and interviews the center did not ensure the care, protection and guidance of children when staff are supervising them.

Evidence:
1. On 08/23/2022 around or about 10:30am, a 5 year-old Child A climbed on one of the outside play structures and was pushed by another child. As a result Child A fell 3'10" onto the surfacing underneath the play structure and sustained a broken elbow. At the time of the fall, the center did not have the required resilient surfacing. There was around 3 inches of surfacing where 6 inches was required.

2. The center had been previously cited for not having the required resilient surfacing at the last inspection on 07/21/2022. The director stated she was aware the playground was not in compliance and had put in a work order for mulch prior to this citation but had yet to have it delivered.

3. In a follow-up email on 07/28/2022, the district manager stated, " I have made our facilities team aware of this and they are slated to come down this coming month to tour centers and ensure we are correcting these issues." Thirty two-days elapsed from the time of the original citation and when the child sustained the injury.

Plan of Correction: Mulch was delivered on 08/24/2022. The play area where the injury occurred now has at least 6 inches of mulch underneath the equipment.
