Technical Assistance:
Provided consultation on 8VAC20-780-420B, that staff should promptly inform parents when persistent behavioral problems are identified.

Comments:
An unannounced monitoring inspection was conducted on 8/11/22 at 1:00pm and 8/22/22 at 9:00am to investigate a self-reported incident regarding behavioral guidance. Interviews were conducted and documentation was reviewed. Video footage of the incident was observed. Two violations were issued as a result of this inspection. Violations:
Standard #: 8VAC20-780-340-F
Description: Based on staff interviews and review of video footage, the center did not ensure that children under 10 years of age always be within actual sight and sound supervision of staff.

Evidence:
On 8/8/22, at approximately 1:20pm during an incident involving behavioral guidance, a staff member left 13 children (ages 5 and 6) alone in gym 3.

Plan of Correction: Inform all staff members they will always be within sight and sound of children at all times. Staff will be reprimanded if child is left out of sight and supervision. Inform them that they are never to leave a child unattended at no circumstances. Use walkie talkies for assistance.

Standard #: 8VAC20-780-400-B
Description: Based on staff interviews, video observation and documentation review, a staff member did not use behavioral guidance that was constructive in nature, age and stage appropriate, or intended to redirect a child to appropriate behavior and resolve conflicts.

Evidence:
On 8/9/22, at approximately 1:20pm, two children (ages 5 and 6 years old) were playing in gym #3. One child threw a ball to another child and that child kicked it back. The ball came close to hitting staff #1 in the head.

1)Staff #1 became angry and slapped the ball from the children?s hands. Staff #1 began yelling at the two children and motioned to them to sit on a bench on the other side of the gym.
2)Staff #1 followed the children to the bench area and bent over the children and began aggressively yelling at them into their faces.
3)Staff #1 then guided the children from gym #3 into the lobby then the gameroom. As they left the gym, Staff #1 flung the door open causing it to slam loudly against the wall and startling those in the vicinity.
4)Interviews from staff witnesses indicated Staff #1 then yelled at the 2 children: ?If I was your parents, I would beat your behind?.
5)Interviews from staff witnesses revealed that the staff member?s voice was loud enough to be heard throughout the gyms, the game room, and the lobby area.

Plan of Correction: Inform all staff members of an incident we had, under no circumstances will a staff yell or scream at a child. The staff should redirect the children to another area that is safe for them to play. Staff will be instructed to take a training on positive guidance in which it will show how to interact with children and prevent such things from happening again.
