Comments:
A renewal inspection was conducted on 09/06/2022. There were 39 children present and 9 staff. The inspector emailed the provider a list of items required to complete the inspection. The Inspector reviewed 2 children?s records and 3 staff records, along with any requested program records submitted by the facility to determine if required documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-270-A
Description: Based on observation the center did not ensure all areas of the center, inside and outside, were maintained in a safe condition.

Evidence:

1. The wooden handicap ramp leading into the building had an opening at the top that measured around 7 inches wide. Spaces measuring more than 4 inches may pose a head entrapment hazard to children.

Plan of Correction: The following corrective action was provided by the owner/director via email:
Handicap ramp has been approved by the VSBC - Virginia State Building Commission and has passed inspections for the past 12 years. Bullfrogs and Butterflies will re-measure all spaces to ensure they are four' 'inches or less, and any other safety issues that can be located will be corrected.

Standard #: 8VAC20-780-330-B
Description: The center did not ensure where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99.

Evidence:
The merry-go-round on the outside pay area did not have any resilient surfacing. This piece of equipment required resilient surfacing at least 6 inches deep with a 6 foot fall zone.

Plan of Correction: The following corrective action was provided by the owner/director via email:
Playground safety implemented with the Merry-go-round is to have one staff member within arms distance when Merry-go-round was in use since having a resilient surface near the wheels was a hazard when in use. Since it is mandatory to now have a resilient surface with this equipment, we will have to remove it from the playground.

Standard #: 8VAC20-780-440-E
Description: Based on observation and interview the center did not ensure there was at least 12 inches of space between occupied cots.
Evidence:
During nap a classroom of children were observed sleeping on cots that were lined in a row and did not have any space between them. In a second classroom the owner and staff were placing cots down to prepare for nap. The cots were lined up in a row with no space between them. The inspector asked the owner about the 12 inches of spacing that is required between each cot. The owner said there was not enough room to provide the space between the cots and "we will just bite the violation, as we have in the past."

Plan of Correction: The following was corrective action was provided by the owner/director via email:
Bullfrogs and Butterflies has only been able to provide 4-6 inches of spacing between cots versus the 12 inches required by social services due to the size of our classrooms. Bullfrogs and Butterflies is actively applying for an allowable variance for this.
