Comments:
The licensing inspector conducted an investigation In response to a self-report that was received in the licensing regarding allegations in the area of behavioral guidance and forbidden actions. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the allegation. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-410-1
Description: Based on observation and interview the center did not ensure actions that are considered forbidden did not occur.
Evidence:
On 09/16/2022 the program director contacted licensing and made a self-report in regards to a parent-concern of an incident that occurred in the toddler room on 09/14/2022. On 09/16/2022 the licensing inspector, along with the District Manager viewed video footage that was approximately 3 minutes long. In the video staff in the toddler room were observed rough handling children in their care.
1. Video footage showed Staff A on the classroom floor with both legs out in front of her as she rough handled children to keep them close as they waited to get their hands washed. The following was observed:
a. Staff A roughly grabbed a 1 year-old child #1 by the arm as he walked away from her.
b. Staff A pulled 1 year-old children #1 and #3 by their clothing as they walked away from her.
c. Staff A grabbed 1 year-old child #3 who was walking away from her, by the back of her pants, causing her body to lift off the floor and all four limbs to dangle before placing her back onto the floor. The same child wiggled her body all over the floor in an attempt to again, move away from the staff. Staff A grabbed the child by her clothing again and this time pulled her across the floor towards her lap.

d. Staff A laid her arm across Child #3?s body to restrict her movement. The staff at no time spoke to the child or looked back at her as she wiggled and twisted her body underneath the staff?s arm. Child #3 managed to wiggle herself out again and walk away. This time Staff A grabbed the child by the ankle and pulled her body on the floor to her.

2. Staff B grabbed 1 year-old child #1 under the arms and roughly placed him next to Staff A, when he wandered from the sink area.

Plan of Correction: Corrected on 09/19/2022. Staff B and C were retrained on classroom management and child interaction which included the state provided training provided by licensing. Staff A no longer works for company. Management and DM are conducting random classroom observations weekly to ensure compliance.
