Comments:
A renewal inspection was conducted on 09/28/2022. There were 26 children, ages 4 years-10 years, 2 staff members providing direct supervision, and support staff present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, physical plant, staffing and supervision, programs, special care provisions and emergencies and special services. The children were observed during arrival, meal time, homework time and outdoor time. The inspector discussed the following with the provider: first aid training. A total of 5 children?s records, 2 staff records, 4 agent/officer records and 2 medications were reviewed. The inspector arrived for the inspection at 2:30 pm and departed at 5:45 pm.
Information gathered during the inspection determined non- compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and discussion with staff, the center failed to ensure that all employees shall undergo a background check in accordance with the Code of Virginia prior to employment or beginning to serve as a volunteer and every five years thereafter.
Evidence: The most recent sworn statement for Staff 1 was dated 02/14/2017. Staff 3 confirmed there was not a sworn statement for 2022 available during the inspection.

Plan of Correction: Required information will be obtained by 09/29/2022.

Standard #: 22.1-289.036-A
Description: Based on record review and discussion with staff, the center failed to ensure that every applicant for licensure as a child day center shall undergo a background check in accordance with the Code of Virginia prior to issuance of license and every five years thereafter.
1. The most recent sworn statement for Agent 1 was dated 08/14/2017. Staff 3 confirmed there was not a sworn statement for 2022 available during the inspection.
2. The most recent sworn statement for Agent 2 was dated 08/14/2017. Staff 3 confirmed there was not a sworn statement for 2022 available during the inspection.
3. The most recent sworn statement for Agent 3 was dated 08/20/2017. Staff 3 confirmed there was not a sworn statement for 2022 available during the inspection.

Plan of Correction: Required information will be obtained by 09/29/2022.

Standard #: 8VAC20-770-60-C-2
Description: Based on record review and discussion with staff, the center failed to obtain the findings from a search of the central registry within 30 days of employment.
Evidence: The record for Staff 2 contained a documented hire date of 06/20/2022. Staff 3 confirmed there was not a finding from the search of the central registry available for review.

Plan of Correction: Required information will be obtained by 09/29/2022.

Standard #: 8VAC20-780-60-A-8
Description: Based on record review and discussion with staff, the center failed to ensure a written care plan for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction.
Evidence: The record review for Child 1 documented a diagnosed food allergy. Staff 3 confirmed no allergy care plan was available for review.
