Comments:
An unannounced monitoring inspection was conducted on 9/14/2022 and 9/19/2022, in conjunction with the local department of social services, to investigate a self-reported incident regarding supervision of children and care, protection and guidance. Staff interviews were conducted, documentation and a video tape were reviewed and observations were made. Violations were issued as a result of this inspection. An exit interview was conducted on 10/5/2022.

Violations:
Standard #: 8VAC20-780-270-A
Description: Based on observation, review of a video tape, and interviews with staff, not all areas of the center outside the facility were maintained in a safe and operable condition. Evidence: The gate in the outside play space had a latch that was not functioning properly and an alarm that did not work, allowing a two year old child to open the gate and exit the play space.

Plan of Correction: The gate was fixed the same day.

Standard #: 8VAC20-780-340-A
Description: Based on observation and interviews with staff, the facility did not ensure the care, protection and guidance of children in care. Evidence: 1) On September 12, 2022 between approximately 3:40-3:50 pm, child #1, age two, exited the outdoor play space through a gate that was not latched properly. Staff #2 stated they did not see child #1 exit the outdoor play space because they were sitting on the ground, legs crossed, with their back to the gate. Staff #1 stated they didn?t see child #1 exit the outdoor play space because they went inside to get balls and hoola hoops for the children to play with. Staff #1 stated they were not aware that the child was missing until a bystander peeked through the open gate and stated ?I think one of your kids got out.? Child #1 was retrieved by a bystander, approximately 50 feet from a road next to the facility, and taken to staff in the front office.

Plan of Correction: Teachers will be retrained on care, protection and guidance.

Standard #: 8VAC20-780-340-F
Description: Based on staff interviews, the facility failed to ensure that all children under ten years of age were within actual sight and sound supervision of staff at all times. Evidence: On September 12, 2022 between approximately 3:40-3:50pm, child #1, age two, exited the outdoor play space through a gate and wandered outside the fenced area near a parking lot and road. Staff #2, who had just reentered the outdoor play space from inside the facility stated they were informed by a bystander that one of their children was missing. Staff #2 then proceeded out the gate and walked to the front office where they found child #1, who had been retrieved, and returned to the facility, by a bystander. Child #1 was out of staff sight and sound supervision for approximately 1-5 minutes.

Plan of Correction: Teachers will be retrained on supervision during outside play times.

Standard #: 8VAC20-780-350-B-3
Description: Based on review of documentation and interviews with staff, the facility failed to maintain the ratio of one staff for every eight children, two years of age. Evidence: On September 12, 2022 between approximately 3:40-3:50pm, one staff member was alone with 11 children in the outdoor play space for approximately 1-3 minutes. The youngest child in the group was two years old.

Plan of Correction: Teachers will be retrained on proper ratios.
