Comments:
The licensing inspector conducted an unannounced monitoring inspection on Tuesday, September 27, 2022 from 10:40am to approximately 12:50pm. There were a total of 63 children in care in the direct care of 11 staff members. During the inspection, the children and staff were observed participating in a variety of activities. Staff were observed having positive interactions with the children. All areas of the facility including classrooms, kitchen, hallways, playgrounds, and bathrooms were inspected. The required postings were reviewed and found to be in compliance. Medication is administered when required and medication and medication authorizations were reviewed. The center is equipped with toys and supplies and items were available to the children. During the inspection, six children?s records and six staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-160-A
Description: Based on a review of six staff records, the center did not obtain documentation of a negative tuberculosis (TB) screening for two staff within the required timeframe.

Evidence: 1) The TB screening in the record for Staff #3, employed 06/06/22, was dated 06/16/22. Documentation of the screening shall be submitted at the time of employment and prior to coming into contact with children.

2) The TB screening in the record for Staff #5, employed 02/23/22, was dated 10/08/21. The documentation should have been completed within the last 30 calendar days of the date of employment.

Plan of Correction: TB screenings or tests will be obtained prior to employment and will not be more than 30 days prior to employment.

Standard #: 8VAC20-780-70
Description: Based on a review of six staff records and interview, the center did not maintain a complete record for two staff person.

Evidence: 1) The record for Staff #1, employed 08/18/22, did not contain a signed sworn statement. 2) During interview, a member of management reported the sworn statement for Staff #1 was signed on 08/18/22, but the original document was misplaced and not maintained as required. A sworn statement or affirmation is a background check required by the regulation entitled Background Checks for Licensed Child Day Centers and required to be in each staff record.

3) The references in the record for Staff #3, employed 06/06/22, were dated 06/10/22 and 06/20/22. Each staff record should contain documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering. 4) During interview, a member of management reported references were obtained prior to employment, but they were not documented as required.

Plan of Correction: The sworn disclosure will be located or a new one signed. In the future, when references are taken, they will be documented as required.
