A complaint inspection was initiated and concluded on 9/30/2022 in response to a complaint that was received in the licensing office on 9/27/2022. The inspector reviewed compliance in the areas of administration, staffing and supervision. Observations were made in each classroom. Informal interviews were conducted with staff on site and staff schedules were viewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. The complaint was deemed to be valid.

Standard #: 8VAC20-780-350-C Complaint related: No Description: Based on observation and interview, the licensee did not ensure that when children are in ongoing mixed age groups, the staff-to-children ratio and group size applicable to the youngest child in the group shall apply to the entire group.
Evidence:
The inspector observed 7 children, ages 1 year to 11 years of age with one staff in the ?Older One-Year-Old Classroom? upon arrival at 8:05 a.m. on 9/30/2022.
Staff #1, who was supervising these children, stated that there were 3 children who were one year old, 1 five year old child, 2 eight year old children, and one 11 year old child present.
Based on the ages of the children in the mixed age group in the ?Older One Year Old Classroom?, there should have been at least 1 staff for every 5 children.
At 8:20 a.m. additional staff arrived at the center and children were moved to other classrooms resulting in three children, all one year old, with 1 staff in the ?Older One-Year-Old Classroom?.
The staff in charge confirmed that it is a routine practice to combine classrooms in the first part of the morning until more children and additional staff arrive.Plan of Correction: RESPONSE
The program director will submit a plan of correction within 5 days of receipt of the violation notice.
