A monitoring inspection was conducted on 11/02/2022, to follow-up on areas of non-compliance in previous inspections. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-400-B
Description: Based on observation the center did not ensure behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

When the inspector entered the center at approximately 12:30pm yelling was heard coming from down the hallway. The inspector and program director went down the hall and observed the following:
1. In the 2 year-old room Staff #1, using a loud and harsh tone said the following statements that could be heard from outside of the classroom: "Get on your cot!! Sit. Lay down. Stop biting.?
2. When the inspector and program director approached the room, staff were transitioning to nap time. Children were observed sleeping on cots while a few of the children were awake wandering the classroom.
3. Staff #1 was observed trying to block Child A in the corner of the room. Staff #1 picked the child up and put him down on his cot. Child A got up from the cot and ran around the room again. Staff #1 followed the child and continued this sequence of chasing and physically putting him on the cot multiple times. One of the times Staff #1 was observed grabbing the child by the body to put him on the cot because he was flailing on the floor.
4. Simultaneously, two other children were wandering the room. Staff #2 stepped into the classroom and begin picking children up under the arms and putting them on their cots.

Plan of Correction: The center provided the following response:
1. Staff have recognized the music was too loud getting ready for nap which elevated their tones across the room. We discussed voice tones with staff and retrained on 11/2/2022. Each day we have a curriculum manager who is working between classrooms to assist teachers in positive guidance and behavior. Management and DM periodically inspect virtually and in person for compliance.
2. Yes it was naptime
3. This child?s cot was in the corner of the room so the staff was working with the child near the child?s cot. The teacher handled the child with hands under the arms and was assisting putting him back on the cot multiple times as the child was trying to run away from the teacher. Instead of going back and forth with one student while the rest of the room still needed to be transitioned, the staff was retrained to have transition activities and spreading out teachers to have better control of the classroom and so students could redirect themselves in other areas until they were ready to go onto cots for naptime. Working with transitions in smaller groups to break up the flow of having all the students get on cots at the same time will aid in the flow as well.
4. Picking up the children under the arms with two hands is the proper method of safely handling children but should be reserved for younger children for safety purposes.
