Comments:
A monitoring inspection was conducted on 10/07/2022 from the hours of approximately 9:30 a.m. to 11:50 a.m. A self-reported incident was received by the department on 09/27/2022 regarding supervision. An investigation in response to the self-reported incident was initiated on 10/07/2022 and concluded on 11/02/2022. A complete inspection of the physical plant and playground was completed. Staff interviews were conducted. Video footage, staff and children records, attendance records, medication, and emergency drills were reviewed. The evidence gathered during the investigation supported the self-report of non-compliance with standards or law, and violations were issued. Standard #: 8VAC20-780-40-E
Description: Based on staff interview and policy review, staff failed to follow the center?s own policies and procedures on Face-to-Name transition.

Evidence:
1. The center has a Face-to-Name Transition and Attendance procedure that states ?a Face-to-Name Transition must be conducted and documented for all group and individual transitions.? Staff #1 signed a copy of this written procedure on 11/25/2019.

2. Staff #1 lined up their children to transition them from Pre-K 1 to the Intermediate classroom for nap time.

3. Staff #1 stated that they did not conduct the Face-to-Name transition prior to moving the children from the Pre-K 1 classroom to the Intermediate classroom.

Standard #: 8VAC20-780-340-A
Description: Based on interview and review of the center?s video footage, when staff were supervising children, they did not always ensure their care and protection.

Evidence:
1. On September 27, 2022 at approximately 12:33 p.m., the video recording shows Staff #1 leaving the Pre-K 1 classroom. Child #1 (age: 3 years) is seen sitting on the carpet, behind a shelf as Staff #1 exits the classroom. Staff #1 was not aware that the child had been left in the classroom.

2. Staff #1 stated that they did not conduct the Face-to-Name transition prior to moving the children from the Pre-K 1 classroom to the Intermediate classroom.

3. Approximately 5 seconds after Staff #1 exits the classroom, the video recording shows Child #1 leaving the carpet area and walking to the classroom door. Next to the classroom door is a window that looks out into the hallway. The child is seen peeking through the window, pulling on the classroom door handle and kicking the window.

3. Staff #2 stated that they saw Child #1 ?knocking the window and went to get? the child.

4. At approximately 12:34 p.m., the video recording shows a staff member opening the classroom door and retrieving Child #1.

Description: Based on interview and review of the center?s video footage, a child under 10 years of age was not within actual sight and sound supervision of staff at all times.

Evidence:
1. On September 27, 2022, Child #1 (age: 3 years) was out of actual sight and sound supervision for approximately one minute.

2. Staff #1 stated that they lined up their children to transition them from Pre-K 1 to the Intermediate classroom for nap time. They stated that they did not conduct the Face-to-Name transition prior to moving the children.

3. On September 27, 2022 at approximately 12:33 p.m., the video recording shows Staff #1 leaving the Pre-K 1 classroom. Child #1 is seen sitting on the carpet, behind a shelf as Staff #1 exits the classroom.

4. Approximately 5 seconds after Staff #1 exits the classroom, the video recording shows Child #1 leaving the carpet area and walking to the classroom door.

5. At approximately 12:34 p.m., the video recording shows a staff member opening the classroom door and retrieving Child #1.

Description: Based on attendance record review and staff interview, the staff-to-children ratios were not always maintained whenever children were in care.

Evidence:
1. After reviewing the paper and electronic attendance records, it was determined that on 09/27/2022 the Pre-K 1 (3 year old classroom) had a ratio of one staff member with eleven children, leaving the classroom out of ratio.

2. Staff #1 stated that they were the only teacher in the classroom with 11 children.
