Technical Assistance:
Technical assistance given and licensing standards regarding disciplinary actions, forbidden actions, and behavioral guidance.

Comments:
A complaint inspection was conducted on October 19, 2022 in response to a complaint that was received by the department on October4, 2022, regarding allegations in the care of the children at the center. Staff were interviewed, documentation was reviewed, classroom observations were completed, and a tour of the facility was conducted. The complaint was determined to be not valid however during the course of the investigation there were concerns outside of the matter of the allegations. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program. The violation was discussed with the Director at the exit interview.

Description: Based on observation, it was determined that the center did not ensure that the actions or threats thereof are forbidden: roughly handling.
Evidence:
1. During observations of a classroom, Staff #2 was observed to verbally prompt Child #1 by saying " Didn't I say turn around?" to sit correctly in their chair. Staff #2 forcefully grabbed Child #2's shoulders and arms to move Child #1 correctly in the chair. Staff #2 then proceeded to lift the chair while Child #1 was still sitting in it, and carry them to another area in the room. The chair was lifted about 2 feet off the ground.
2. Video footage was taken during this incident in the classroom and the Director and Assistant Director observed the forbidden actions of Staff #1.

Plan of Correction: The center responded with the following: Staff #1 will speak to Staff #2 and put the appropriate disciplinary actions as deemed appropriate by their program.
