Comments:
A monitoring inspection was conducted on 10/12/2022 with the center director and center staff. There were 26 children present with 5 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 4 staff records were reviewed. The children were waking from rest, having afternoon snack, and playing on the playground.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-160-A
Description: Based on review of 4 staff records, the center failed to obtain documentation of a negative tuberculosis (TB) screening or test for each staff at the time of employment and prior to coming in contact with children. Staff 1 (date of employment 8/22/2022) had a TB test on 8/29/2022, Staff 2 (date of employment 8/23/2022) had a TB test on 8/31/2022, Staff 3 (date of employment 8/26/2022) had a TB test on 9/8/2022, and Staff 4 (date of employment 8/24/2022) had a TB test on 9/23/2022.

Plan of Correction: Staff will get a tuberculosis test or screening prior to employment and prior to direct contact with children.

Standard #: 8VAC20-780-70
Description: Based on review of four staff records, the facility failed to have required documentation in each file. Two references as to character, reputation, and competence should be checked prior to employment. Evidence: Staff 2 (date of employment 8/23/2022) and Staff 4 (date of employment 8/24/2022) did not have documentation of two references on file.

Plan of Correction: References will be checked and documented prior to employment.

Standard #: 8VAC20-780-340-F
Description: Based on observation, the facility failed to have all children under 10 years of age within sight and sound supervision of staff. Evidence: there were 3 children in the toddler room (Sea Lions) without a teacher in the room for at least 5 minutes.

Plan of Correction: Children will be in actual sight and sound supervision at all times.

Standard #: 8VAC20-780-350-M
Description: Based on observation, the center failed to ensure that one staff member shall not supervise more than one room or area during rest time. Evidence:
1. There were 3 children in the toddler room (Sea Lions) without a teacher in the room for at least 5 minutes.
2. The center director stated that the 2 year old classroom teacher was supposed to be watching both the toddler and two year old classrooms from the hallway.
3. The 2 year old teacher was changing a child in the two year old classroom, leaving the toddler room unattended.

Plan of Correction: Staff will not be asked to supervise two classrooms during rest time.

Standard #: 8VAC20-780-440-H
Description: Based on observation, the facility failed to provide cribs that meet the requirements of the Consumer Product Safety Commission (CPSC). Evidence: three of the four cribs being used in the infant room were mesh sided port-a-cribs, which can not be used for sleeping.

Plan of Correction: Cribs that meet CPSC standards will be purchased.

Standard #: 8VAC20-780-500-B
Description: Based on observation, the facility failed to ensure disposable diapers are disposed in a storage system that is either foot operated or used in such a way that neither the staff member's hand nor the soiled diaper touches an exterior surface of the storage system during disposal. Evidence: Soiled diapers were observed in a plastic bag hanging from a door knob of the door to the infant room. The door could not be closed without moving the bag of soiled diapers out of the way.

Plan of Correction: Diapers will be disposed of in a foot operated disposal pail.

Standard #: 8VAC20-780-560-M
Description: Based on observation, the center failed to prevent children from walking around while drinking. Evidence: a toddler was observed walking around and drinking from a sippy cup.

Plan of Correction: Children will not be allowed to walk around while eating or drinking.
