Comments:
An unannounced inspection was conducted on November 4, 2022 from approximately 1:45 pm to 2:30 pm in response to a self-reported supervision incident. The department received the self-report on October 27, 2022. The Licensing Inspector conducted interviews and documentation was gathered and reviewed while at the center.

The preponderance of evidence gathered during the investigation supports violation of standards in regards to the self-reported incident.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today, 11/21/2022. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Violations:
Standard #: 8VAC20-780-240-A
Description: Based on records review, and interview, the center failed to ensure that staff complete the Virginia Department of Education (VDOE) sponsored orientation course within 90 calendar days of employment. Evidence: The records for staff #1, date of employment 5/5/22, and staff #2, date of employment 10/12/21, did not contain evidence of the VDOE orientation. The Director stated that staff #1, and staff #2, did not take the VDOE orientation course.

Plan of Correction: Per the Director "management will ensure that all staff complete the appropriate training within the required timeframe of hire moving forward and will review current files to schedule training to bring staff up to compliance."

Standard #: 8VAC20-780-270-A
Description: Based on interview, the center failed to ensure that equipment of the center is maintained in a safe and operable condition. Evidence: During interview, staff # 1 stated that the cabinet under the diaper table is broken. The Director confirmed that the cabinet is broken.

Plan of Correction: Per the Director "an additional work order has been submitted to repair or replace the broken locking mechanism on the diaper changing cabinet."

Standard #: 8VAC20-780-340-F
Description: Based on interview, and documentation review, the center failed to ensure that children under 10 years of age are always within actual sight and sound supervision of staff. Evidence: Documentation review of the incident report, dated 10/25/22, completed by staff #2, and given to the parent, stated that child #1 was ?found by the sink.? The sink is attached to the diaper table, located in the classroom, and is approximately 4 feet tall. Staff #1 stated that the children and staff were gathered on the carpet, in the classroom, when they found child #1 standing by the sink.

Plan of Correction: Per the Director "teachers will be re-coached on the proper way to move about the classroom during different activities to maintain full sight supervision of all students in their care around any visual obstacles that may be present."

Standard #: 8VAC20-780-520-C
Description: Based on interview, the center failed to ensure that diaper ointment is inaccessible to children. Evidence: During interview, staff #1 stated that child #1 was able to access a container of diaper cream that was stored in a low, unlocked cabinet.

Plan of Correction: Per the Director "all topical creams have been removed from the cabinet that had a broken locking mechanism and are stored in an alternate locked cabinet away from student access. A work order has been placed for the locking mechanism to be repaired on 11/04/22."
