Comments:
A self-reported incident was received by the department on 11/18/2022 regarding allowing a nine year old to leave with a teacher of the public school in which the center is located on 11/02/2022 who was not listed as an authorized pick up. An investigation was conducted and concluded on 11/30/2022. Documents were reviewed and interviews were conducted with staff and the child?s parent. Information gathered during the investigation of the self-report determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the program. Violations:
Standard #: 8VAC20-780-40-E
Description: Based on staff interviews and documentation reviewed, the center's activities and services were not maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence:
1.The center's policy on supervision states: ?Participants must always be within sight and sound, except when participants are in the restroom. The center?s policy on authorized pickups states: Anyone picking up a participant must be listed as an authorized pick up on the participant?s information form or in the participant?s Brightwheel account. Individuals listed as an authorized pick up must provide a photo ID upon arrival at the PRCS facility.?
2. Staff #1 stated that on 11/2/2022 at approximately 2:49pm, she allowed Child #1 to leave with a teacher of the public school in which the center is located (?teacher?) who was not listed as an authorized pick up for Child #1. Staff #1 did not ask for a photo ID and stated the teacher told Staff #1 her name, but could not remember their name. Staff #1 stated she was not within sight and sound supervision of Child #1 during the time the child was with the teacher.

Plan of Correction: Staff will only allow children to leave the program with an authorized pick up and will verify their identity by requesting a photo ID.

Standard #: 8VAC20-780-340-F
Description: Based on interviews, it was determined that the center did not ensure that all children 10 years of age or younger were always within actual sight and sound supervision of staff.
Evidence:
1.On 11/02/2022, Child #1 (9 years old), was not within actual sight and sound supervision of staff for an undetermined amount of time.
2.Staff #1 checked Child #1 (9 years old) into the center at approximately 2:49pm. Child #1 left the center with an unauthorized person, a teacher of the public school in which the center is located (?teacher?), a few minutes after the child arrived. Child #1 was found by Staff #1 in the hallway with the teacher at approximately 4:40pm. Staff #1 stated ?I normally don?t let them go, but I trusted [child #1] and the teacher. Child #1 wanted to go and seemed happy.??
3.The parent of Child #1 stated that they had not authorized the teacher to take Child #1 out of the center?s care.

Plan of Correction: Staff will not allow children to work with the LCPS staff without written permission.
