Comments:
An investigation was initiated on 10/28/22 in response to a self-reported incident received by the department regarding a staff/child interaction. An on-site inspection was conducted on 12/13/22 and interviews with staff were conducted. Documentation and records related to the incident were also reviewed. Based on the information gathered during the investigation, the self-reported incident is determined to be valid. A violation in the area of programs is cited on the violation notice and was discussed with center management at the conclusion of the investigation.

Violations:
Standard #: 8VAC20-780-400-B
Description: Based on staff interviews, it was determined that the center did not ensure that behavior guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflict.

Evidence:
1. The center self-reported that a staff person witnessed another staff person ?slapping? toys out of child 1?s, age 2 years, hands on 10/27/22.
2. Staff 1 (center director) stated she was observing the two?s classroom through a window on 10/27/22 when she witnessed staff 2 telling child 1 to ?sit down now? in a loud and inappropriate tone. Staff 1 stated staff 2 then went over to child 1 and ?smacked? the two toy cars child 1 was holding out of his hands. Staff 1 stated child 1 then fell to the floor and started crying.
3. Staff 3 stated that on 10/27/22 she was changing a child?s diaper in the two?s classroom when she heard staff 2 speaking in an ?aggressive? tone towards child 1 to put a toy car away. Staff 3 stated that she then looked over to child 1 and saw him fall to the floor.
4. Staff 4 stated that on 10/27/22, while working in the two?s classroom, she witnessed staff 2 speak to child 1 in a loud and inappropriate tone to put the toys he was holding away and then ?grab? him by his arm. Staff 4 stated child 1 fell to the floor and began crying. Staff 4 stated that staff 2 appeared to be ?frustrated? and that she looked ?irritated? with child 1.
5. Center management confirmed that staff 2 did not demonstrate age and stage appropriate behavior guidance in the classroom and that redirection utilized by staff 2 was not constructive in nature.

Plan of Correction: The center responded with the following: Immediate actions taken due to incident: The teacher was terminated due to behaviors witnessed by the Center Director. To ensure all teachers understand our policy on positive guidance, re-training was providing following the teacher?s termination. This training included ensuring all teachers understand that only positive guidance such as redirection, praise and modeling of pro-social behavior is appropriate when supporting children in the classroom. Daily observation will be using KinderCare?s SET observation tool will continue to be utilized in all classrooms by the Center Director and Assistant Director to ensure positive guidance is being practiced by all teachers.
