Comments:
An unannounced investigation was conducted on 12/15/2022, and a follow up was conducted on 01/05/2023, in response to a complaint that was received by the licensing office on 12/14/2022, regarding programs. Based on staff interviews, observations and documentation reviewed, the preponderance of evidence gathered during this investigation supports the allegation. This inspection report was amended on February 23, 2023 and reissued on February 23, 2023.The complaint is determined to be valid, violations are identified on the Violation Notice. Complaint related: Yes
Description: Based on review of the center's video recording, staff interviews and review of the center's written policies and procedures, it was determined that the center failed to comply with its own policies and procedures as it relates to behavior guidance.

1. The Center's "Prevention and Response" guidelines, under "Positive Behavior Support" states: "We embrace a Positive Behavior Support model that works to prevent challenging behavior in young children." "Children are more likely to develop self-control when they are treated with dignity and given clear, consistent, and fair limits for classroom behavior." " When children struggle with making appropriate behavior choices, our approach is to embrace these teachable moments by helping children learn social-emotional skills, through teaching, modeling, and coaching in the moment." "The following types of discipline are prohibited: Restricting a child's movement by binding, tying, or any other type of physical restraint or time-out, including lifting or carrying a child."

2. The center staff did not follow its own policies and procedures on 12/12/2022 at approximately 3:53pm when: A) Staff #1 directed Child #1 (4 years old) to sit on a chair, without offering an alternative activity or redirection. B) Staff #1 chased Child #1 around the classroom then grabbed Child #1 under their left arm, placed the child over their shoulder and proceeded to carry the child with their feet dangling off the ground to another classroom. C) Staff #1 pulled Child #1's sleeve to direct them to pick up the chairs the child had kicked to the floor.

Plan of Correction: Teachers have been retrained on the Positive Behavior resources available to them in a time of need.
Teachers have been reminded to consult with the inclusion services team and/or management when questions or support is needed with a child who has an inclusion packet on file.

Description: Based on staff interview and review of the center's video recording, it was determined that a staff member did not use behavioral guidance that was constructive in nature, age and stage appropriate and intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:

The video recording for December 12, 2022, was reviewed by La Petite Academy Administration and Licensing Inspectors and the following was confirmed:

1. On 12/12/2022 at approximately 3:51pm, Child #1 (4 years old) picked up a cylinder mat and began to roll it around the Multipurpose room. Staff #1 is observed taking the cylinder mat from Child #1 and putting it away. Staff #1 then walks Child #1 towards a chair and directs them to sit on the chair.

2.Child #1 sits down on the chair, but then the child gets up and starts walking away from the chair. Child#1 is observed running away from Staff #1, while Staff #1 is trying to get to them.

3. At approximately 3:53pm, Staff #1 is observed lifting the child up from under their left arm, placing the child over their shoulder as they proceed to carry the child with their feet dangling off the ground to the School-age classroom, which is adjacent to the Multipurpose room.

4. While in the School-age classroom Child #1 is observed walking around the classroom and knocking down two chairs. Staff #1 then walks towards Child #1, pulls the child from their sleeve, and takes the child back to the chairs that the child knocked down to pick them up.

Plan of Correction: At the time of the interaction in question. It was observed via center camera's that the school's Team Lead/Safety Captain (a member of the management team) observed the interaction in live time and retrained/coached the teacher regarding positive guidance immediately after the observation.
The teacher in question received coaching in the moment along with follow up training.
