Comments:
A complaint inspection was conducted on January 19, 2023 in response to a complaint that was received by the department on December 29, 2022, regarding allegations in the care of the children at the center. Staff were interviewed, documentation was reviewed, classroom observations were completed, the video of the incident was observed, and a tour of the facility was conducted. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Description: Based on observation and interview, it was determined that the center did not ensure that during the stated hours of operation, there always shall be on the premises when one or more children are present one staff member who meets the qualifications of a program leader or program director and an immediately available staff member, volunteer or other employee who is at least 16 years of age, with direct means for communication between the two of them.
Evidence:
1. On December 19th, during the time of the incident at 5:18pm, Staff #2 was the only staff present with 10 children in care.
2. Staff #2 confirmed being the only adult caretaker during the incident and was presently caring for 10 children with the youngest child being 1 years old.
3. Staff #1 confirmed that Staff #2 was the only staff present in the building at that time of the incident on December 19, 2022.

Plan of Correction: Kelly?s Kare initially request the staff child modification ratio guidelines during the pandemic due to low staff but In moving forward Kellys Kare will ensure that 2 staff members are scheduled for the entire duration of the shift and that no staff is left alone during that first and last hour of dismissal or arrival and that we adhere to the ratio guidelines as it pertains to the youngest child in the room even based on the anticipated expected time of dismissal based on if something can go wrong it will theory, because on this day a staff member left @ 5:10pm and the 1 year is normally gone by 5:00pm and the said incident happened at 5:18 so we will go back to making sure our staff to child ratio is back to normal moving forward.
And no 1 staff member is left alone.

Description: Based on observation and interview, it was determined that the center did not ensure that when children are in ongoing mixed age groups, the staff-to-children ratio and group size applicable to the youngest child in the group shall apply to the entire group.
1. On December 19th, during the time of the incident at 5:18pm, Staff #2 was the only staff member present with 10 children in care with the youngest child being 1 years old. The ratio of staff to children is 1 staff member to every 4 children based on the youngest child in care.
2. Staff #2 confirmed being the only staff member present with 10 children ranging from the ages of 1 years old to 10 years old.
