Comments:
An unannounced non mandated monitoring inspection was initiated on 12/28/2022 and concluded 02/27/2023. A self report was received on 12/28/2022. Interviews were conducted with children and staff in conjunction with an outside partner agency on 1/18/2023 and 01/20/2023. Additional documents were received on 1/25/2023, 2/2/2023, and 2/10/2023.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-350-B-5
Description: Based on interviews and attendance, the center failed to ensure the staff-to-children ratio for school age eligible children up to age 9 years.

Evidence:
On 12/27/2022, there were 25 school age children with one staff person. Staff 2 confirmed the 25 children in attendance under 1 staff. The youngest child was 5 years old. The ratio for this age group would be 1 staff to 18 children. Two staff would be required.

Plan of Correction: All Caterpillar Clubhouse directors and locations were given a directive to review the latest staffing requirements per the 2021 Licensing Standards and should be operating in full compliance to these staffing regulations.

Standard #: 8VAC20-780-410-1
Description: Based on document review and interviews conducted by licensing staff and an outside partner agency, the center failed to ensure that physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment did not occur.

Evidence:

1.Child 1 (age 6) stated that ?a teacher hurt my arm?. Child 1 identified the teacher as Staff 1. Child 1 also stated Staff 1 ?squeezed my arm and put me on the wall.?
2.Child 2 (age 7) observed the incident and stated that Child 1 was running around the classroom and Staff 1 grabbed the child?s arm and screamed in the child?s ear. Then Child 2 observed Staff 1 placing Child 1 into time out at the wall.
3.Forensic Nurse Examiner Report documented the following observed on Child 1: an area of purple bruising noted to the right upper arm, an abrasion noted to the right forearm, and an abrasion noted to left upper arm. Child 1 was asked by the Forensic Nurse Examiner ?Can you tell me what happened the other day at daycare??. Child 1?s documented response was ?A teacher hurt my arm, really tight?.

Plan of Correction: All staff at Caterpillar Clubhouse #2 location were required to watch a training video entitled ?Positive Behavior Management in the Early Childhood Classroom?
During a recent professional development day, 86 of 125 employees participated in a review of the company Abuse Risk Management Handbook. All employees are required to read this handbook when they are hired, however we felt it was important to take this time to review the handbook in a live setting. Special attention and discussion were provided regarding situations like the incident on 12/27/22.
