Comments:
The licensing inspector conducted an unannounced complaint inspection on 04/26/2023 In response to a complaint that was received in the licensing office, regarding allegations in the area of Supervision and Emergencies. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the allegation. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Description: Based on record review and interviews the center did not ensure the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards.

Evidence:

1. The center's policy for Positive Guidance and Redirection states:
"Each staff member's goal should be to help each child learn self-control and self-
discipline. You can achieve this by using positive guidance, including the following steps:
Encouraging children to use language to resolve conflicts whenever possible , Redirecting
children to alternate activities as necessary and modeling positive behavior.

a. "The center did not follow their own policies and procedures when staff # 2, using a
harsh tone, repeatedly said "No!" a few times to a child doing donkey kicks against the wall
and trying to climb it inverted on his hands. No other redirection was used.

2. The center's policies and procedures required staff complete a face-to-name document each time they are transitioning children from one area to another and when they cross over any threshold.

a. On 04/18/2023 at approximately 10:45am staff did not complete a face-to-name check prior to coming into the building from being outside. Subsequently a child was left on the playground unsupervised for approximately 2 minutes.

Description: Based on a record review, interviews and viewing of video footage the center did not ensure the care, protection and guidance of the children in their care, when staff are supervising children.

Evidence:
On 04/18/2023 at approximately 4pm, child #1 sustained an injury to his mouth and jaw, resulting in the child receiving outside medical care. Staff #1 and #2 had fifteen 2-year-old children lined-up to go to the gym. The Teacher Assistant was at the door with the new program leader explaining how to complete the center?s face-to-name sheet. Staff reported the children had already been in line for about 5 minutes before they began to become restless.

a. Video footage showed children running around the classroom and climbing on top of furniture. Neither Staff #1 or #2 engaged the children or attempted to redirect behavior. Both staff were observed conversing with each other at the door.

b. Video footage showed Child #1 running in the classroom when he fell, and his face hit the
seat of a wooden chair. Staff #1 and #2 each stated they did not see child #1 fall but
heard him scream.

c. Staff #1 stated there was ?blood everywhere.? Staff #4 reported there was so much blood
she couldn?t tell where it was coming from.

d. During interviews staff #2 stated , "I had my back to the children for 10 minutes,"
and "I wasn't paying attention."

e. Medical documentation confirmed child #1 had several impacted teeth and partial
separation of the periodontal ligament resulting in loosening and displacement of the
maxillary (main front teeth). In addition, the medical documentation notated accompanied
upper lip soft tissue swelling. A referral was made to a pediatric dentist for further
evaluation.

Description: Based on a record review, observation and interviews the center did not ensure children under 10 years of age were always within actual sight and sound supervision.

Evidence:
On 04/18/2023 at around 10:45am, a 2 year-old child #2 was left unsupervised on the playground. Staff #5 discovered child #2 approximately 2 minutes after staff #1, #2 and #3 had taken child #2's class of 19 two year-old children back inside the building.

Description: Based on observation the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. The 2 year-old room was observed for approximately 40 minutes. The following was observed with no behavioral guidance from staff that redirected or resolved conflict.
a. Children climbing on top of foam blocks
b. Child standing on top of a toy basket
c. Child standing on top of the sand table.
d. Children throwing trucks around the room
e. At the end of the art activity in the 2 year-old room, Child #3 took a paint saturated paper towel and got paint on toys, the shelves and other equipment in the classroom.
f. 2 children were observed fighting over a bottle of bubbles. The 2 children stumbled to the ground and began hitting each other.

2. During an art activity in the 2 year-old room, Child #4 was observed painting his face and clothing. Child #4 crawled on a table to get more paint. Child #4 ate paint and began spitting on himself for at least 3 minutes until the inspector brought it to the attention of staff.

3. In the 2 year-old classroom a child was observed on top of a classroom table on his stomach and another standing on top of a toy basket. At the time the program director and regional manager were present in the room. Neither staff redirected the behaviors or acknowledged the.

Description: Based on a record review and interview the center did not ensure a written record of a child's serious injury was made the day of the occurrence.

Evidence:
1. On 04/18/2023 interviews confirmed staff in the 2 year-old room asked the parent of child#1, to sign a "blank" incident report as she was picking up her child who had just sustained a serious injury to the face.

2. The director asked staff to complete a second incident report on 04/26/2023 and ripped the original into pieces. The program director showed the inspector and district manager the torn original document that was no longer readable. The second injury report was not given to the parent and did not contain the following required information:
a. Type of injury
b. Any future action to prevent recurrence of the injury
c. Staff and parent signatures or two staff signatures
d. Documentation on how parent was notified.

Description: Based on observation the center did not ensure foods that are potential choking hazards were not served to children under the age of 3 years-old.
Evidence:
0n 04/26/2023 the children in the 2 year-old classroom were served various pieces of banana: some were about 2" in length and other pieces cut into round slices. USDA recommends food are to be cut length wise and no larger than 1/2" and cut into small strips rather than round pieces.
