Comments:
An inspection was conducted on 4/19/2023 in response to a self reported incident regarding a child who was not in sight and sound supervision of staff. The investigation included review of documentation and policies, inspection of the playground area staff interviews.
Two staff records and one child record were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

The inspection was discussed with the program director during an exit interview.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based upon review of procedures and staff interview, the facility has not ensured that all activities and services are in compliance with their own policies and procedures.
Evidence:
1. The facility's policy for the outdoor learning environment states that "Before returning inside, conduct a Name to Face of all the children"
2. Staff 1 stated that on 4/12/2023 she failed to conduct a Name to Face of the children prior to coming inside the building as the app on the tablets on which this was to be conducted was down (not working)..

Plan of Correction: The facility responded with the following:
After the incident, the staff member was terminated immediately. As well as self-reporting to licensing, the child?s parents were notified immediately and the child is still enrolled at the center. We reviewed name to face and headcount attendance policies and provided attendance lists on paper copies to be used in case the app is not working or is running slow. We also reviewed playground safety and conducting playground sweeps.

Standard #: 8VAC20-780-340-A
Description: Based upon staff interview, the facility has not ensured that when staff are supervising children, they always ensure their care and protection.
Evidence:
1. On 4/12/2023, staff 1 did not ensure the care and protection of child 1 when child 1, two years old, was left alone on the outdoor playground when staff 1 brought the rest of the children in her care back into the building.
2. Child 1 was on the playground for approximately 1 minute before staff 1 discovered that child 1 had not come in from the playground with the rest of the class.
3. Staff 1 stated that child 1 was crying at the door from the playground to the building when staff 1 went to retrieve her.
4. Staff 1 stated that she did not know how many children for which she was responsible because the application on the staff tablets was not working.

Plan of Correction: The facility responded with the following:
After the incident, the staff member was terminated immediately. As well as self-reporting to licensing, the child?s parents were notified immediately and the child is still enrolled at the center. Description: Based upon staff interview, the facility has not ensured that children under 10 years age are within actual sight and sound supervision of staff.
Evidence:
1. Child 1, two year old, was not in sight and sound supervision by staff on 4/12/2023, when she was left alone on the playground when both toddler classes were brought inside from the playground.
2. Staff 1 stated that child 1 was alone on the playground (out of sight and sound supervision of staff) for approximately one minute before staff 1 discovered that she had not come inside with her class.
