A complaint inspection was conducted on December 12, 2023, in response to a complaint that was received by the department on October 26, 2023, regarding allegations of forbidden action at the center. Staff members were interviewed, documentation was reviewed, classroom observations were completed, video footage was reviewed, and a tour of the facility was conducted. The evidence gathered during the investigation determined that the complaint is valid with regards to forbidden action. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program. The violation was discussed during the exit interview with the Curriculum & Program Director of the center. The complaint investigation was fully completed on January 5, 2024.

Standard #: 8VAC20-780-410-1
Complaint related: No
Description: Based on observation, record review, staff documentation review, and interviews, it was determined that the center failed to ensure that the following actions are forbidden: roughly handling and restricting movement of a child as punishment.
1. Child #1?s parent observed during pick up on October 24, 2023, that Child #1 had a busted lip that was slightly bleeding. Child #1 reported to his parent that Staff #1 hit their head on the wall in the bathroom because they would not take a nap.?
2. Per the documentation provided by Staff #2, Program Director, as well as Staff #2?s interview, in observing the video footage in the classroom, Staff #1 was observed rough handling the child on two occasions before forcefully pulling him from his cot and taking him into the bathroom because the child would not take a nap. After taking the child out of the bathroom, Staff #1 was observed placing both of their legs across Child #1 while on the cot and continued to check under the blanket they placed over Child #1?s head to see if the child was sleeping.
3. Staff #4 confirmed hearing loud screams from the bathroom on October 24, 2023, during naptime at the center. Staff #4 notice that when Child #1 was picked up by a parent, they had had a ?busted lip.?
4. Staff #2 and Staff #3 confirmed that the actions by Staff #1 are against the policies of Children?s Harbor and failed to keep the child safe. Staff #1 violated the agency?s policy of discipline.
5. As a result of the actions in the classroom with Child #1, Staff #1 was terminated on October 25, 2023.

Plan of Correction: The center responded with the following: Staff #1 was terminated effective immediately. To further prevent any other occurrence, staff had a re-training regarding both the Standards and the policies regarding discipline and forbidden action, for the State of Virginia and for Children's Harbor. Class observations will continue to be monitored routinely.
