Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
A monitoring inspection was conducted on 05/15/2024 from 12:05 PM to 2:15 PM. There were 52 children present with nine staff ranging in age from infant to five years. The inspector reviewed compliance in the areas of administration, staff qualifications and training, physical plant, staffing and supervision, programming, medication, and special care and emergencies. A total of five children?s records, two new staff?s records and three staff records were reviewed for updates.
Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 8VAC20-780-280-B
Description: Based on observation, the center failed to ensure hazardous substances such as cleaning materials were kept in a locked place using a safe locking method that prevents access by children.

Evidence:

In the infant room, the closet beside the changing table was unlocked with bleach spray and a bleach bottle on the floor.
The closet in the hall bathroom downstairs was unlocked. There was bleach and Lysol disinfectant on the floor.
Under the sink in the bathroom used by children in the hall on the main floor was Scrubbing Bubbles bathroom cleaner.

Plan of Correction: All hazardous substances were moved to a locked location. Staff will be advised to search their classrooms each day for hazardous substances upon arrival and ensure cabinets and closets are locked after use.
