Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced monitoring inspection was initiated on Monday, June 10, 2024, and concluded on Friday, June 14, 2024, to determine the center's compliance with licensing standards. On June 10, the inspector was on site from 2:45pm to approximately 5:00pm. There were a total of 28 children present in the direct care of eight staff members. Upon the inspector's arrival, the children and staff were observed in their respective classrooms. The children were observed during transitions, during free-play, and teacher-led activities. The center is equipped with age-appropriate materials and equipment for the children's use. Staff were engaged with the children and offered guidance when needed. The areas where children receive care were inspected and found to be in compliance. The required postings were observed. Medication is administered and medications and authorizations were reviewed. Per the Director, transportation is not provided. During the inspection, five children's records and five staff records were reviewed. Additional documentation was submitted electronically on June 11 and June 14, 2024. Information gathered during the inspections determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 22.1-289.035-B-2 Description: Based on a review of five staff records and interviews, the center did not obtain the satisfactory results of a national fingerprint-based criminal record search for one staff prior to employment.
Evidence: The national fingerprints-based criminal record search in the record of Staff #3, employed on 05/29/23, was dated 06/02/23.
During interview, a member of management confirmed Staff #3 started employment on 05/29/23 and the fingerprint-based criminal record search was obtained after.Plan of Correction: Corrected.
Standard #: 22.1-289.035-B-4 Description: Based on a review of five staff records and interviews, the center did not obtain a required out-of-state background check from any state in which one staff had resided in the preceding five years within the required timeframe.
Evidence: The record of Staff #3, employed on 05/29/23, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain the results of the child abuse and neglect registry from that state. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of employment. During interview, a member of management confirmed the required out-of-state background check for Staff #3 had not been obtained to date.Plan of Correction: Obtained on 06/11/24.
Standard #: 8VAC20-780-150-B Description: Based on a review of five children's records and interviews, the center did not ensure one child's immunization and physical examination reports shall be signed by a physician, his designee, or an official of a local health department.
Evidence: The physical examination and dates immunizations were received in the record of Child #4, date of attendance 08/23/23, was not signed by a physician, his designee, or an official of a local health department. During interview, a member of management confirmed the center did not have the signed report.Plan of Correction: Obtained on 06/12/24.
Standard #: 8VAC20-780-160-A Description: Based on a review of five staff records and interviews, the center did not ensure one staff shall submit documentation of a negative tuberculosis (TB) screening within the required timeframe.
Evidence: The TB screening in the record of Staff #3, employed on 05/29/23, was dated 06/12/23. During interview, a member of management confirmed Staff #3 started employment on 05/29/23, prior to obtaining a negative TB screening.
Documentation of the screening shall be submitted at the time of employment and prior to coming into contact with children. The documentation shall have been completed within the last 30 calendar days of the date of employment and be signed by a physician, physician's designee, or an official of the local health department.Plan of Correction: Corrected.
Standard #: 8VAC20-780-240-A Description: Based on a review of five staff records and interviews, the center did not ensure one staff completed the Virginia Department of Education-sponsored orientation course within 90 calendar days of employment.
Evidence: The record of Staff #3, employed on 05/29/23, did not contain documentation that the staff completed the VDOE orientation course. During interview, a member of management confirmed Staff #3 had not complete the VDOE orientation course to date.Plan of Correction: Will complete moving forward.
Standard #: 8VAC20-780-245-A Description: Based on a review of five staff records and a review of documentation, the center did not ensure one staff shall complete annually a minimum of 16 hours of training appropriate to the age of children in care.
