Comments:
An unannounced complaint investigation was initiated on 6/28/24 with the center?s Directors and owner in response to a complaint received in the licensing office regarding an allegation related to supervision. The inspector was on-site from 10:45am-12:30pm and conducted further interviews off-site. Based on review of documentation and observed evidence, and interviews conducted, the allegation regarding supervision was determined to be valid. Information gathered during the investigation determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program. Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for the violation cited and return to me by close of business on 7/10/24. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.

Description: Based on review of observed evidence and interviews, the center did not ensure that children under 10 years of age were always within actual sight and sound supervision of staff. Evidence: On 5/23/24 Child A, six-years-old, and Child B, nine-years-old, entered ?the Art Room? by themselves and closed the door. For approximately two minutes the children remained in the closed classroom by themselves, climbing on top of and walking across tables. After approximately two minutes Child B opened the door and exited the classroom and Staff #1 was then observed entering the classroom to remove Child A.

Plan of Correction: Our school age building layout and materials are designed to always provide sight and sound supervision when there is a staff located in the common area. Our centers, including the art room, are surrounded by wall-to-wall thin glass windows and a door made 95% of thin glass. The materials are not designed to block out sight or sound. At the time of the incident listed above (6:15pm), we had four school age children, and three staff members in the common area (two extra staff per Licensing requirement). The three staff members were interviewed by the Licensor, and they all stated that they could see and hear the two children in the ?art room? since they were in the common area.

*The regulation does not state that a staff member must intervene to be providing sight and sound supervision.

Plan of Action: Staff were retrained on ?behavior intervention techniques? and ?use of antecedent modifications? to prevent/respond to problem behaviors.
