Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site renewal inspection was initiated and completed on July 8, 2024. The on-site inspection began at 9:15am and ended at 11:30am. The inspector reviewed compliance in the areas listed above. There were 67 children present and 8 staff. The inspector reviewed 6
children?s records and 5 staff. This inspection included document review, tour of the facility, interviews,
and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-3
Description: The center shall obtain a copy of the results of a search of the central registry maintained pursuant to ? 63.2-1515 for any founded complaint of child abuse or neglect against him. The center did not request the Virginia Central Registry checks for Staff #1, Staff #2, Staff #3, and Staff #4 and were all present at the center working with children.

Plan of Correction: The center responded with the following: The Director will send all the necessary documents to obtain the results of the Virginia Central Registry checks. Once checks are complete, they will be sent to the LI and printed in their files.

Standard #: 8VAC20-780-160-A
Description: Staff are to obtain documentation of a negative tuberculosis (TB) screening at the time of employment and prior to coming into contact with the children. Staff #2 has no documentation of a TB screening completed and was present at the center working with children.

Plan of Correction: The center responded with the following: Staff #2 will be sent to get the TB screening completed this week. Results will be placed in the staff record.

Standard #: 8VAC20-780-210-A
Description: Staff program leaders shall be at least 18 years of age, have fulfilled a high school program completion or the equivalent, and have six months of supervised programmatic experience. Three program leaders at the center did not include documentation to demonstrate that each individual possesses the education, certification and/or experience required by the
position of program leader.

Plan of Correction: The center responded with the following: The center will obtain documentation of the staff members meet qualifications of a lead teacher. Their transcripts and copies of their diploma will be placed in their files.

Standard #: 8VAC20-780-330-B
Description: Where playground equipment is provided, resilient surfacing shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles. The mulch around the playground equipment was low and sparce where dirt and grass under the mulch was visible.

Plan of Correction: The center responded with the following: More mulch will be purchased to ensure that the resilient surfacing is appropriate.
