Licensing standards regarding hazardous substances: 8VAC20-780-280 and lead water testing in 2025.
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced monitoring inspection was conducted on 06/24/24 from 11:18am to 1:36pm. At the time of the inspection there were 20 children in care and 4 staff members. Children were observed participating in various activities including center play, lunch, and teacher led group activities. Records were reviewed for five children and four staff members. Evacuation drills, emergency supplies and other required records and postings were reviewed. The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice and discussed with the director during the exit interview.

Standard #: 8VAC20-780-240-B Description: Based on record review and interview, the center failed to ensure that staff shall complete orientation training prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.
Evidence:
1. The record for Staff #3 (hired 2/8/2023), staff #4 (hired 10/5/2022) and staff 5 (hired 11/2/2021) did not contain documentation of a completed a staff orientation.
2. Staff #3 (Director) confirmed that the record of staff #3, #4 and #5 did not contain documentation of a completed staff orientation.Plan of Correction: 1. Staff #3 received orientation administered by the Center Director within the VA DSS required period. We are unable to locate the form used for documentation of orientation, however the effective start date of orientation was February 8, 2023, the date staff #3 signed the Position Description letter which is also part of the center?s orientation process.
2. Documentation of orientation and training for staff #4 was administered by the center?s director and documented on VA DSS model form ?Staff Information Sheet? 032-0095-eng. Orientation documented as of October 10, 2022, also as indicated on staff #4?s position description which is also part of center?s orientation process.
3. Documentation of orientation and training for staff #5 was administered by the center?s director and documented on VA DSS model form ?Staff Information Sheet? 032-0095-eng. Orientation documented as November 5, 2021.The beginning date of orientation was November 4, 2021, as indicated on staff #5?s position description, which is also a part of the center?s orientation process and completed on November 5, 2021.
