Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced inspection was initiated on May 17, 2024, and concluded on June 6, 2024, as a result of a self-report received in the licensing office on May 17, 2024. The on-site inspection began at 10:00am and ended at 11:15am. The inspector reviewed compliance in the areas listed above. There were 82 children present and 16 staff. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-340-F
Description: When staff are supervising children, they shall always ensure their care, protection, and guidance. On May 17, 2024, Child #1 (age 2) was able to exit the toddler playground unsupervised for approximately one minute.

Evidence:
1. Staff #1 allowed 6 toddlers (ages 16 months to 2 years old) to go outside on the playground without a staff member in front of them or already on the playground.
2. Child #1 was able to exit the toddler playground unsupervised running the parameter of the preschool building.
3. Staff #2, toddler teacher, was the last to get out the door and while completing the name to face attendance, notice that Child #1 was not present.
4. Staff #3, preschool teacher, observed Child #1 running alone the sidewalk outside her window and immediately called for the Director to get the child outside.
