22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, on-site monitoring inspection was conducted on July 23, 2024. The on-site inspection began at 12:20 pm and ended at 2:10 pm. The inspector reviewed compliance in the areas listed above. There were thirty-six children present and eight staff. The inspector reviewed five children?s records on-site and five staff records electronically on July 23, 2024 and July 24, 2024. This inspection included document review, tour of the facility, interviews and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Standard #: 22.1-289.035-B-4 Description: Based on review, facility did not ensure required out of state background checks are completed when an individual has lived outside the state of Virginia within the past 5 years.
Evidence: The record for staff #2 (start date 4/17/2023) had documentation that they had lived in two other states within the past 5 years prior to beginning employment.
