Technical Assistance:
Licensing standards regarding physical plant (8VAC20-780-270), procedures for emergencies (8VAC20-780-550) and lead water testing in 2025 were discussed with the director.

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An announced, on-site initial inspection was initiated on July 8, 2024 and completed on July 8, 2024. The on-site inspection began at 9:50am and ended at 12:50pm. The inspector reviewed compliance in the areas listed above. The inspector reviewed 7 staff records on-site. No children are enrolled at this time. This inspection included document review, a tour of the facility, interviews, observations and measurements. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-270-A
Description: Based on observation and interview, the center did not ensure that areas and equipment of the center, inside shall be maintained in a safe condition.
Evidence:
1. Inspectors used a small object choke tester in each classroom and the following choking hazards were observed in each of the infant, toddler and preschool classrooms.
a. Multiple display boards with small clothes pins and round magnets within reach of children.
b. Manipulatives, figurines, and art materials on multiple shelves throughout the classroom within reach of children.
2. The following injury hazards were observed in the infant classroom.
a. Plastic toy animals and various metal cooking utensils with sharp edges that could cut if put in the infant?s mouth.
3. Staff #1, the director confirmed that the materials that could cause choking and injuries were present in the classrooms.

Plan of Correction: All classroom/art chalk in the Toddler classrooms were replaced with egg shaped chalk to prevent potential choking hazards.
The teacher's display boards in the infant and toddler classrooms were immediately removed from the classrooms.
The toy spatula in the practical life area was removed from the classroom.

Standard #: 8VAC20-780-280-B
Description: Based on observation and interview, the center did not ensure that hazardous substances such as cleaning materials shall be kept in a locked place using a safe locking method that prevents access by children.
Evidence:
1. There were cleaning and sanitizing products with the ?keep away from children? label stored in an unlocked cabinet in a bathroom accessible to children.
2. Staff #1, the director confirmed that the hazardous substances in the bathroom were not locked and accessible to children.

Plan of Correction: The hand soap and aerosol air freshener spray were removed from the staff/adult restrooms and placed in a locked closet.
