22.1 BACKGROUND CHECKS, CODE, CARBON MONOXIDE

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated on 08/14/2024. The on-site inspection began at 9:45 am and ended at 12:00 pm. The inspector reviewed compliance in the areas listed above. There were 79 children and 11 staff present. The inspector reviewed 5 children?s records and 5 staff records on site. The inspection included: document review, a tour of the facility, interviews, observations, and measurements of the playground.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 8VAC20-780-270-A
Description: REPEAT VIOLATION

Based on observations, the center failed to ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence:
1. The screws on the seat of the wooden picnic table on the playground were loose allowing the seat to move up and down creating a pinch point. Children were observed using the table during the inspection.
2. The wooden siding of the building, in the playground area, is deteriorating in several areas and exposes the nails and screws.
3. The molding around the flooring in the school-age classroom is loose in two areas and creates a tripping hazard. A child was observed tripping and falling over the loose molding during the inspection.

Plan of Correction: The repairs will be made.
